215712v1 <br />CITY OF ARDEN HILLS <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION NO. 2021-038 <br /> <br />RESOLUTION VACATING A CERTAIN PUBLIC <br />SEWER EASEMENT LOCATED IN THE CITY OF <br />ARDEN HILLS, RAMSEY COUNTY, STATE OF MINNESOTA <br /> <br />WHEREAS, Minnesota Statutes § 412.851 provides for the vacation of public ways, which <br />includes easements, and the process for said vacation; and <br /> <br />WHEREAS, after the statutorily required two (2) weeks published and posted notice and mailed <br />notice to the abutting property owners, to consider the vacation of an easement for public sewer purpose <br />over, on, across, under and through the land legally described in Exhibit A, and depicted on Exhibit B, <br />attached hereto and incorporated herein, the City Council of the City of Arden Hills has conducted a <br />hearing on July 12, 2021, at which hearing all persons interested to be heard thereon were given an <br />opportunity to be heard; and <br /> <br />WHEREAS, following the hearing and consideration of the proposed vacation of public sewer <br />easement, the City Council has determined the easement is not needed for purposes of a public sewer and <br />that it is in the public interest to vacate the sewer easement. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Ci ty Council of the City of Arden Hills, <br />Ramsey County, Minnesota: <br /> <br />1. The public sewer easement described herein is hereby vacated. <br /> <br />2. The City Clerk is directed to file a certified copy of this Resolution with the County Auditor <br />and County Recorder/Registrar of Titles in and for Ramsey County, Minnesota. <br /> <br />3.
