Page 1 of 2 <br /> <br />CONSENT ITEM – 6F <br /> <br />MEMORANDUM <br /> <br />DATE: July 26, 2021 <br /> <br />TO: Honorable Mayor and City Councilmembers <br /> Dave Perrault, City Administrator <br /> <br />FROM: Jessica Jagoe, Senior Planner <br /> <br />SUBJECT: Findings of Fact and Decision Regarding Application of Kye Samuelson for a <br />Variance at Property 3493 Siems Court (Planning Case 20-017) <br /> <br /> Budgeted Amount: Actual Amount: Funding Source: <br /> $ $ <br /> <br />Council Should Consider <br /> <br />Motions to approve, table, or deny the following: <br /> <br />• Motion to adopt Resolution 2021-041 for the Findings of Fact and Decision Regarding <br />Application of Kye Samuelson for a Variance at Property 3493 Siems Court in Planning <br />Case 20-017. <br /> <br />All items need a simple majority for action unless otherwise noted. <br /> <br />Background <br /> <br />On July 12, 2021, the City Council considered the application of Kye Samuelson for a Variance <br />to the Shoreland Regulations to increase the maximum height allowed for an accessory structure <br />within the required structure setback from the OHWL from 8’ to 9’ 5” in height at 3493 Siems <br />Court (Planning Case 20-017). The application for the proposed Variance was denied by a 4-1 <br />vote. The City Council directed the City Attorney to prepare formal findings for review and <br />approval by the Council at its next regular meeting. The City Attorney has completed the <br />Findings of Fact and Decision document, which is included in Attachment B. <br /> <br />
