The City Council will be asked to make a formal <br />decision regarding the application under Agenda Item 9D. <br /> <br />Background <br /> <br />Earlier this year, the City Council had reviewed a variance request to construct an accessory <br />structure near the shoreline along Lake Johanna and amended the Shoreland Regulations to <br />permit accessory structures within the required structure setback from the ordinary high water <br />level of up to 100 square feet in size and 8 feet in height. During those planning case reviews it <br />was discovered that there was a discrepancy between the City’s shoreland lake classification for <br />Lake Johanna and Little Johanna from the designation of the Minnesota Department of Natural <br />Resources (DNR). Upon further research it was determined that action the City Council had <br />taken in May 1985 approving Resolution 85-22 (Attachment A) was never formally processed <br />and approved by the DNR. This resolution had either not been submitted to the DNR or was <br />misplaced in processing on their end. The formal request of Resolution 85-22 to the DNR was <br />for shoreland reclassification of Lake Johanna, Little Johanna Lake, and Karth Lake from <br />Recreational Development to General Development. <br />
