Page 2 of 3 <br /> <br />Overview of Ordinance Amendments <br /> <br />Staff has prepared draft ordinance language with new language added in red font for your review <br />(Attachment A). Language has been incorporated into the City ordinances to allow for the <br />keeping of chickens and added requirements for the associated accessory structures/uses (i.e. <br />coop, pen, and exercise yard). Those regulations are referenced in two Chapters of the city code. <br />The applicable Chapters and Sections are as follows: <br /> <br />• Municipal Code Chapter 4 – Animals and Pets <br />o Amend - Section 400.01, Definitions <br />o Add - Section 410.01 Subd. 3, Chickens License <br /> <br />• Zoning Code Chapter 1325 – General Regulations <br />o Amend – Section 1325.07 Subd. 6.A., Location for Buildings Housing Farm <br />Animals <br /> <br />The following are a few of the summary items of the proposed ordinance amendments: <br />• Biannual license requirement for the keeping of chickens. <br />• Limitation on number of chickens allowed – maximum 3 hens, roosters prohibited. <br />• Insertion of size limitations for coop, pen, and exercise yard – coop shall be 12 to 25 sq. <br />ft., pen minimum 10 sq. ft. per bird, and exercise yard minimum 174 sq. ft. per bird. <br />• Notification for Neighbor Consent. <br />• Spacing and screening requirements between adjacent parcels and the area dedicated to <br />chickens – closer to principal dwelling than adjacent property, 6 ft. tall perimeter <br />screening of solid fence or vegetation. <br />• Exemption for an allowance of a third accessory structure with a single car detached <br />garage. <br />• Penalty and removal language for violations and/or discontinuance of chickens. <br /> <br />The Planning Commission may notice that the proposed ordinance language refers to the fee <br />schedule for the license amount. Changes and adoption of rates within the fee schedule does not <br />require review of the Commission. The City Council consensus during the work session <br />discussion has been a biannual license amount of $30.00. An ordinance amendment shall be <br />brought forward to the City Council for the fee schedule in parallel to the ordinance review. <br /> <br />Lastly, an ordinance amendment to the Zoning Code does require a public hearing before the <br />Planning Commission. <br /> <br />Additional Review <br />N/A <br />Findings of Fact <br /> <br />The Planning Commission must make a finding as to whether or not the proposed application <br />would adversely affect the surrounding neighborhood or the community as a whole based on the <br />aforementioned factors.
