Page 2 of 3 <br /> <br />language includes a requirement that a resident who intends to keep chickens shall have read the <br />document outlining best care practices. <br /> <br />At the July 26th special work session, Staff was directed to bring forward the proposed ordinance <br />to the Planning Commission in September for the first review and to hold a public hearing to <br />receive public comment on the keeping of chickens. <br /> <br />Discussion of Ordinance Amendments <br /> <br />Staff has prepared draft ordinance language with new language added in red font for your review <br />(Attachment A). Language has been incorporated into the City ordinances to allow for the keeping <br />of chickens and added requirements for the associated accessory structures/uses (i.e. coop, pen, <br />and exercise yard). Those regulations are referenced in two Chapters of the city code. The <br />applicable Chapters and Sections are as follows: <br /> <br />• Municipal Code Chapter 4 – Animals and Pets <br />o Amend - Section 400.01, Definitions <br />o Add - Section 410.01 Subd. 3, Chickens License <br /> <br />• Zoning Code Chapter 1325 – General Regulations <br />o Amend – Section 1325.07 Subd. 6.A., Location for Buildings Housing Farm <br />Animals <br /> <br />The following are a few of the summary items of the proposed ordinance amendments: <br />• Two year license requirement for the keeping of chickens. <br />• Limitation on number of chickens allowed – maximum 3 hens, roosters prohibited. <br />• Insertion of size limitations for coop, pen, and exercise yard – coop shall be 12 to 25 sq. <br />ft., pen minimum 10 sq. ft. per bird, and exercise yard minimum 174 sq. ft. per bird. <br />• Notification for Neighbor Consent – Initiated by licensee and responses are returned to <br />City. <br />• Spacing and screening requirements between adjacent parcels and the area dedicated to <br />chickens – closer to principal dwelling than adjacent property, 6 ft. tall perimeter screening <br />of solid fence or vegetation. <br />• Exemption for an allowance of a third accessory structure with a single car detached <br />garage. <br />• Penalty and removal language for violations and/or discontinuance of chickens. <br /> <br />The City Council under Agenda Item 9E will be asked to make a formal decision regarding the <br />license fee as stated within the fee schedule. The City Council consensus during the work session <br />discussion has been a license fee of $30.00. <br /> <br />Public Notice and Comments <br />A Zoning Code Amendment requires a public hearing. A public hearing notice for this planning <br />case was published in the Pioneer Press on September 16, 2021. The City has not received any <br />public comments regarding this case.
