2 <br />217909v2 <br />Ramsey County Document No. A____________ (“Amendment”). Terms of the Amendment required the <br />Developer to implement safety improvements on Lake Valentine Road in two phases, to address traffic and <br />increased pedestrian crossings between the school building and the north parking lot which includes, but is <br />not limited to, the installation of turn lanes and other access improvements, trail and sidewalk <br />improvements, pedestrian signal, signage and stripping modifications, as well and drainage and utility <br />improvements, to be completed in 2021 (“Improvements”). <br />[Collectively the Development Contract and Amendment shall be referred to as “Contract”.] <br /> C. The Developer is the fee owner of the property situated in the County of Ramsey, State of <br />Minnesota, and legally described on Exhibit “A” attached hereto (“Subject Property”). <br /> D. Pursuant paragraph 33.E. of the Development Contract, any requested amendments shall be <br />approved by the City subject to the requirements of the Arden Hills City Code and Ordinances. <br /> E. Pursuant to paragraph 28.A. of the Development Contract, the Developer has requested an <br />amendment to the Contract for an extension of time to complete the Improvements. <br /> F. Pursuant to City Code, a PUD Amendment may be approved by a simple majority of the <br />City Council after public hearing and recommendation of the Planning Commission. The Developer shall <br />follow the procedures and requirements of the Contract. This PUD Amendment shall be executed by the <br />City and Developer/Owner, and recorded against the Subject Property. <br /> G. The City Council reviewed and approved the proposed PUD Amendment on August 23, <br />2021. <br />NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS: <br /> 1. The City approves the Developer’s request for a PUD Amendment to the Contract for an <br />extension of time to September 2022 to complete the Improvements based on the findings of fact, <br />submitted plans, and the August 23, 2021 Report to the City Council.
