Page 2 of 2 <br /> <br /> <br /> <br /> <br /> <br />Northern Lights Bingo contains an area that is currently licensed with the City as Brightside Café <br />with limited seating. In order to qualify for a liquor license, the site must contain a restaurant that <br />can seat at least 30 patrons. In the concept plan submittals provided by the applicant (see <br />Attachment A Land Use Application and Attachment B Interior Floor Plans and Site Layout), the <br />proposed restaurant section would have a seating capacity for 32-36 patrons. The City Planner <br />has confirmed the subject property is located in the B-2 General Business District and that <br />restaurants are allowed as permitted uses within this district. <br /> <br />The Applicant Narrative (Attachment C) provides the applicant’s vision for the business which, <br />as one example, includes specific hours of liquor service. It should be noted that staff has advised <br />the applicant that hours of operation for liquor service cannot exceed that which are allowable by <br />City Code, Chapter 5, Section 500.16 Hours and Days of Sale (Subdivisions 1, 3, 5 and 6 below, <br />which mirror State Statute); however, the applicant can certainly be more restrictive regarding <br />the hours of sale. <br /> <br />• Subd. 1 On-Sale Intoxicating Liquor. No sale of intoxicating liquor for consumption on <br />the licensed premises may be made: <br />A. Between 2:00 a.m. and 8:00 a.m. on Monday through Saturday; or <br />B. After 2:00 a.m. on Sunday unless the licensee has also been issued a Sunday <br />onsale liquor license. <br />• Subd. 3 On-Sale 3.2% Malt Liquor. No sale of 3.2% malt liquor may be made between <br />2:00 a.m. and 8:00 a.m. on Monday through Saturday or after 2:00 a.m. on Sunday. <br />• Subd. 5 On-Sale Wine. No sale of wine may be made between 2:00 a.m. and 8:00 a.m. <br />on Monday through Saturday or after 2:00 a.m. on Sunday. <br />• Subd. 6 Sunday On-Sale Intoxicating Liquor. Sales are permitted between the hours of <br />10:00 a.m. on Sunday and 2:00 a.m. on Monday in conjunction with the sale of food. <br /> <br />Based on the submitted layout and plan, this location meets City Code requirements for a <br />restaurant and therefore can pursue a liquor license. If Council is agreeable to this concept plan, <br />staff will facilitate the remainder of the liquor license application process, which includes fees <br />totaling $7,288 to be paid by the applicant for an on-sale intoxicating liquor license (wine, beer <br />and spirits), Sunday sales, and background investigation, and will bring forward said license for <br />formal City approval at the December 13 City Council meeting.
