Following due published and mailed notice the Planning Commission held a public hearing <br />on the application on December 8, 2021, and recommended approval with conditions. The City Council <br />reviewed and approved the proposed PUD Amendment with conditions on January 10, 2022. <br />NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS: <br /> 1. The City approves the Developer’s request for the improvement of the north parking lot <br />and related safety improvements on the site upon the following conditions and pursuant to the plans <br />submitted and the January 10, 2022 Report to the City Council: <br />a. The road construction and realignment as shown on the approved plans must be <br />completed prior to the start of the 2022-2023 school year. <br /> <br />b. All other conditions of the original Planned Unit Development and Amended <br />Planned Unit Development shall remain in full force and effect. <br /> <br />c. The Developer shall install, or pay for the installation of traffic control signage <br />prohibiting U-turns on Lake Valentine Road from Janet Court to the western city <br />border, in locations as determined by the City Engineer. <br /> <br />d. Removal of the existing gas tanks on the site will be completed concurrent with the <br />lot construction and the removal shall be compliant with all MPCA and other legal <br />requirements. <br /> <br />e. The Developer shall install ADA compliant directional pedestrian ramps as <br />approved by the City Engineer. <br /> <br />f. The Developer shall provide additional lighting for the crosswalk as approved by <br />the City Engineer. <br /> <br /> 2. Except as otherwise specifically amended herein, all other conditions of the original <br />Development Contract and Planned Unit Development and Amended Planned Unit Development shall <br />remain in full force and effect. This agreement does not extend or amend the Interim Use Permit <br />conditions set forth in Resolution 2019-035. <br />
