Satisfaction of a park dedication requirement as approved by the City Council. <br /> The motion carried unanimously(6-0). <br /> Commissioner Ricke moved, seconded by Commissioner Zimmerman, to approve <br /> Planning Case #02-25B, Planned Unit Development Master Plan, with the following <br /> recommendations and conditions: . <br /> 1. Approval of a PUD Permit and Development Agreement. <br /> 2. The phasing schedule follow the revised schedule proposed by staff. <br /> 3. An updated traffic study to be completed at the conclusion of Phase I and at the <br /> conclusion of Phase II Development. <br /> 4. Approval of the Final Alternative Urban Areawide Review Mitigation Plan. <br /> S. Submittal of a revised Drainage and Utility Plan as approved by the City <br /> Engineer. <br /> The motion carried unanimously(6-0). <br /> The two aforementioned cases will be presented for the City Council's consideration at the <br /> October 28, 2002 meeting. <br /> Park Dedication Issue <br /> The Guidant property is currently unplatted. As such, a park dedication fee is required. The <br /> following language from the City Code is illustrative: <br /> ". . . the developer of a parcel of land shall dedicate to the public for use as parks, playgrounds, trails, <br /> wetlands or open space, a reasonable percentage of the tract to be developed. In determining the <br /> percentage of dedication, the City Council shall take into consideration the amount of open space,park, <br /> recreational or commons areas and facilities which the developer has designed into the proposed <br /> development for use by occupants of the development. The City Council shall be guided by the following <br /> criteria in establishing a particular percentage dedication requirement:. . . <br /> . _.Nonresidential projects or combination residential and commercial projects. The percentage of <br /> dedication for nonresidential projects or combination residential/commercial projects shall not exceed ten <br /> (10%)percent_ . . . <br /> Cash in lieu of dedication. In lieu of the dedication of land for recreational and conservation purposes, the <br /> City Council may require the developer to pay to the City, as an equivalent contribution,an amount in cash <br /> equal to the percentage of the land required to be dedicated, multiplied by the fair market value of the <br /> property at the time of final approval of the development application." <br />
