CONSENT ITEM— 6C <br /> ,-iIZEN HILLS <br /> MEMORANDUM <br /> DATE: August 22, 2022 <br /> TO: Honorable Mayor and City Councilmembers <br /> Dave Perrault, City Administrator <br /> FROM: Julie Hanson, Assistant to the City Administrator/City Clerk <br /> SUBJECT: Interim Ordinance 2022-006 Establishing a Moratorium related to THC Products <br /> Budgeted Amount: Actual Amount: Funding Source: <br /> N/A N/A N/A <br /> Council Should Consider <br /> Motion to approve, table, or deny the following: <br /> • Adoption of Ordinance 2022-006—Interim Ordinance Prohibiting the Sale, Testing, <br /> Manufacturing and Distribution within the City of Products Containing <br /> tetrahydrocannabinol (THC) and Authorization to Publish Summary Ordinance <br /> The Ordinance amendment requires a simple majority for^action. The Summary Ordinance requires a 415 vote. <br /> Backuound/Discussion <br /> On July 1, 2022, the Minnesota Legislature adopted an amendment that permits the sale of edible <br /> cannabinoid products that contain no more than 0.3% of THC (a derivative of hemp). The <br /> amendment was enacted with very few regulations in place, such as prohibiting sales to anyone <br /> under 21 years of age, individual dosage limitations (products can contain no more then 5 <br /> milligrams per serving and no more than 50 milligrams per package), and certain requirements <br /> for packaging and warnings. Individual cities are tasked with the responsibility of determining <br /> what, if any, additional licensing and/or regulations to pursue in their municipality. <br /> The City Council discussed this topic at a special work session on August 8 (Attachment A). <br /> Council directed staff to draft an interim ordinance that would establish a one-year moratorium <br /> which will allow the Council and staff adequate time to further study this matter. Staff has <br /> worked with the City Attorney regarding ordinance language (Attachment B) as well as a <br /> summary ordinance (Attachment C). It is important to note this moratorium does not apply to <br /> products containing THC related to the Medical Cannabis Program as administered by the <br /> Minnesota Department of Health,provided the activity is conducted in accordance with state law <br /> regarding medical cannabis. <br /> Page 1 of 2 <br />
