Page 5 of 5 <br /> <br />I. A grading plan with drainage calculations shall be submitted if required by the city <br />engineer. <br />J. The subdivider has complied with the requirements of this chapter which the planning <br />commission or City Council have made the subdivision by registered land survey or <br />survey specifically subject to. <br /> <br />Subd. 3 Such filing fee as has been established in a resolution adopted by the Council shall be <br />paid the zoning administrator with every application for an exemption under this paragraph. <br /> <br />City Code Chapter 11, Subdivisions, Section 1150.01 – Granting Variances states: <br /> <br />Subd. 1 The City Council may grant a variance from the regulations contained in the <br />Subdivisions Chapter as part of the plat approval process following a finding that all of the <br />following conditions exist: <br />A. The hardship is not a mere inconvenience; <br />B. The condition or conditions upon which the request is based are unique and not generally <br />applicable to other property; <br />C. The granting of a variance will not be substantially detrimental to the public welfare and <br />is in accord with the purpose and intent of this chapter, the zoning ordinance and <br />comprehensive plan. <br /> <br />Subd. 2 In making these findings, the Council shall consider the nature of the proposed use of <br />land and the existing use of land in the vicinity, the number of persons to reside or work in the <br />proposed subdivision and the probable effect of the proposed subdivision upon traffic conditions <br />in the vicinity.
