<br />STATE OF MINNESOTA <br /> <br />COUNTY OF RAMSEY <br /> <br />VILLAGE OF ARDEN HILLS <br /> <br />RESOLUTION NO. ?'~-/i <br /> <br />... <br /> <br />RESOLUTION AMEND~NG RESOLUTION NO. <br />73-2 TO RESCIND ,AND DELETE THERE- <br />FROM SPECIAL CONDITION NO. 2 <br /> <br />WHEREAS, the Council of the Village of Arden Hills <br />on January 29, 1973 adopted Resolution No. 73-2 approving <br />the proposal of the Ramsey County Parks and Open Space Com- <br />mission to acquire and develop the tracts of land which com- <br />prise the 191 acre Schmidt Park Supplement and Drainage Cor- <br />ridor subject to certain conditions one of which, Special <br />Condition No.2, reserved to the Council the irrevocable <br />right to withdraw its approval as to any tract(s) for the ac- <br />quisition of which the Commission was offering compensation <br />which the Council considered to be inadequate, and <br /> <br />WHEREAS, the Commission, pursuant to its, policy of not <br />granting Special Conditions to a specific municipality that <br />would not be applicable throughout the entire County, resolved <br />on March 8, 1973 in its Resolution No. 1-20 (File No. 14) not <br />to grant to the Council said Special Condition No.2, and <br /> <br />WHEREAS, there is no necessity for the Council to act as <br />an arbiter as to the adequacy of compensation offered by the <br />Commission for the acquisition of tracts within the Corridor <br />because the Commission is constrained by federal and state <br />consitutional provisions and Chapter 117 of Minnesota Statutes <br />to pay fair and equitable compensation for the taking of such <br />tracts and because it has stipulated in its aforesaid Resolu- <br />tion No. 1-20 (File No. 14) that the fair market value for <br />property purchased within the Corridor will be established by <br />two (2) independent real estate appraisals and a third apprai- <br />sal at the option of the owner, <br /> <br />NOW, THEREFORE, BE IT RESOLVED, by the Council of the Vil- <br />lage of Arden Hills that Special Condition No. 2 of Resolution <br />No. 73-2, adopted on January 29, 1973, be and it hereby is <br />amended by rescinding and deleting therefrom Special Condition <br />No.2 and said Resolution No. 73-2, as hereby amended, be and <br />it hereby is reaffirmed. <br /> <br />. <br /> <br />BE IT FURTHER RESOLVED, that the Mayor and the Clerk- <br />Administrator be and they hereby are authorized and directed <br />to cause certified copies of this Resolution to be forwarded <br />to the Ramsey County Administrator, the Ramsey County Parks <br />and Open Space Commission, and such other offices as may be <br />deemed necessary for the purpose of carrying out the provisions <br />hereof. <br /> <br />Dated at Arden Hills, Minnesota, <br />1973. <br /> <br /> <br />26th day of <br /> <br />~",.~ <br /> <br />Charlotte MCN~ <br />Acting Clerk-Administrator <br /> <br />~j <br />
