<br />. <br /> <br />STATE OF MINNESOTA <br /> <br />COUNTY OF RAMSEY <br /> <br />CITY OF ARDEN HILLS <br /> <br />RESOLUTION NO. f/-gg <br /> <br />. <br /> <br />RESOLUTION INDEMNIFYING COUNCILMEN IN <br />CONNECTION WITH THEIR BEING NAMED <br />DEFENDANTS IN ROBERT K. CARLSON LAWSU-IT <br /> <br />WHEREAS, by Resolution dated ~~1U1~/.J', 1978, the Arden <br />Hills City Council established a pO;i;y-~f~demnifying its <br />Councilmen on a case by case basis, and <br /> <br />WHEREAS, the City of Arden Hills and Henry J. Crepeau, Jr., <br />James W. Wingert, Robert L. Woodburn, Charles F. Crichton, and <br />Ward M. Hanson, in their individual capacities as members of the <br />Arden Hills City Council, have been sued by Robert H. Carlson, <br />and <br /> <br />WHEREAS, said lawsuit, as indicated in its title, involves <br />claims against said Councilmen arising only out of their perform- <br />ance of their duties as such, and <br /> <br />WHEREAS, the claims embodied in said lawsuit do not <br />involve any malfeasance in office or willful or wanton neglect of <br />any duty by any of the above-named Councilmen, and <br /> <br />WHEREAS, each of said Councilmen was acting in good faith <br />in performing the duties which have resulted in the claims em- <br />bodied in said lawsuit, <br /> <br />. <br /> <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE ARDEN HILLS <br />CITY COUNCIL that it is fitting and proper and in the best <br />interest of the City of Arden Hills--because of the facts and <br />circumstances set forth above--that the City of Arden Hills <br />indemnify, hold harmless and defend each of said Councilmen in <br />connection with said lawsuit commenced by Robert H. Carlson; <br />defray any and all attorneys' fees and costs incurred in their <br />behalf in defending said lawsuit~ pay any judgment which might <br />be rendered against each and everyone of said Councilmen at <br />the conclusion of said lawsuit~ and perform any obligations con- . <br />tained in any judgment against each and every one of said <br />Councilmen at the conclusion of said lawsuit. <br /> <br />e <br /> <br />Passed by the Arden Hills City Council this 19th day of <br />June, 1978. <br /> <br />Henry <br />Mayor <br /> <br /> <br />.~~~~ <br /> <br />Charlotte McNiesh, <br />Clerk-Administrator <br />
