5. Amendments to the Zoning Code regulations require a public hearing prior to action by <br />the City Council. <br />6. The Planning Commission conducted a public hearing for the Text Amendment on <br />August 9, 2023. <br />Options and Motion Language <br />The Planning Commission reviewed this application at their August 9, 2023 meeting. At that <br />time, they recommended approval with amendments of Planning Case 23-013 for Zoning Code <br />Amendments to identify criteria between a temporary and permanent fence in all zoning districts <br />as well as set a maximum height for fences in the Business and Industrial Zoning Districts by a <br />6-0 vote (Commissioner Mitchell was absent). The following are motion language options for the <br />City Council to consider: <br />Adoption of Ordinance 2023-008 <br />• Approval: Motion to adopt Ordinance 23-008 for Planning Case 23-013 as presented for <br />Zoning Code Amendments to Chapter 13 in Section 1325.05, Subd. 4.1) of the Arden <br />Hills City Code to add language in the city code establishing criteria for a temporary and <br />permanent fence in all zoning districts as well as set a maximum height for fences in the <br />Business and Industrial Zoning Districts as presented in the August 28, 2023 Report to <br />the City Council. <br />Approval with Amendments: Motion to adopt Ordinance 23-008 for Planning Case 23- <br />013 as presented for Zoning Code Amendments to Chapter 13 in Section 1325.05, Subd. <br />4.13 of the Arden Hills City Code to add language in the city code establishing criteria for <br />a temporary and permanent fence in all zoning districts as well as set a maximum height <br />for fences in the Business and Industrial Zoning Districts, based on the findings of fact <br />and August 28, 2023 Report to the City Council with amendments: a specific reason <br />should be included with all amendments. <br />Denial: Motion to deny of Planning Case 23-013 as presented for Zoning Code <br />Amendments to Chapter 13 in Section 1325.05, Subd. 4.1) of the Arden Hills City Code <br />to add language in the city code establishing criteria for a temporary and permanent fence <br />in all zoning districts as well as set a maximum height for fences in the Business and <br />Industrial Zoning Districts: findings to deny should specifically reference the reasons for <br />denial. <br />Table: Motion to table Planning Case 23-013 as presented for Zoning Code Amendments <br />to Chapter 13 in Section 1325.05, Subd. 4.1) of the Arden Hills City Code to add <br />language in the city code establishing criteria for a temporary and permanent fence in all <br />zoning districts as well as set a maximum height for fences in the Business and Industrial <br />Zoning Districts: the City Council should identify a specific reason and/or information <br />request should be included with a motion to table. <br />Authorization to Publish Summary Ordinance <br />• Approval as Presented: Motion to approve authorization to publish a Summary <br />Ordinance 2023-008 for Planning Case 23-013 for Zoning Code Amendments to Chapter <br />13 in Section 1325.05, Subd. 4.D. <br />Page 3 of 4 <br />
