<br />\. <br /> <br />~ <br /> <br />I..~~.t<dt.,;.".-/ ~.. <br /> <br />STATE OF MINNESOTA <br /> <br />COUNTY OF AAMSEY <br /> <br />CITY OF ARDEN HILLS <br /> <br />RESOLUTION No. 77-JI <br /> <br />A RESOLUTION VACATING PORTIONS <br />OF CONNELLY AVENUE <br /> <br />. <br /> <br />WHEREAS, the Arden Hills City Council by Resolution <br />No. 75-39, passed on August 25, 1975, initiated a proceeding <br />under Section 412.85l of Minnesota Statutes, as amended, to <br />determine whether it would be in the public interest to vacate <br />the hereinafter described portions of Connelly Avenue situated <br />in the City of Arden Hills, County of Ramsey and State of <br />Minnesota, and <br /> <br />WHEREAS, the Clerk-Administrator of the City of <br />Arden Hills published in the New Briqhton: BUll.etin on November 6 <br />and l3, 1975 a Notice of Public Hear~ng on the proposed vacation <br />of portions of Connelly Avenue and also caused copies of said <br />Notice of Public Rearing to be posted for a period of at least <br />two (2} weeks, commencing November 4, 1975, at the Arden Hills <br />City Hall, Lake Johanna Elementary School and the refreshment <br />stand at Lake Johanna Beach, three of the most public places in <br />the City of Arden Hills, and <br /> <br />WHEREAS, a public hearing before the City Council was <br />conducted on Monday, November 24, 1975 commencing at 7:35 o'clock <br />P.M., and <br /> <br />WHEREAS, no one appeared to oppose 'the proposed vacation, <br />and Mr. George Withy, President of W. R. Shaw Lumber Co., one of <br />the abutting property owners, voiced his approval of the proposed <br />vacation, and <br /> <br />. <br /> <br />WHEREAS, the City Council, after the close of the public <br />hearing at 8:25 o'clock P.M., unanimously deemed it to be in the <br />public interest to vacate the portions of Connelly Avenue herein- <br />after described contin,ent upon Cll the City's acquisition of a <br />right-of-way connecting the southeasterly terminus of Connelly <br />Avenue with County Road E without having to pay any compensation <br />therefor, (2l resolution of title problems concerning an approxi- <br />mately 55 foot by 80 foot strip of land partially lying in the <br />right-of-way of the southeasterly terminus of Connelly Avenue and <br />the proposed right-of-way to be acquired, (3} resolution of the <br />, grading, landscaping and parking proposals of Flaherty's Arden <br />Bowl, .Inc., one of the abutting property owners, and '(4} reserva- <br />tion of the City's sewer mains and pipes located in the portions <br />of Connelly Avenue to be vacated, and <br /> <br />WHEREAS, the City Council has deferred passage of this <br />Resolution pending satisfaction of the first three contingencies <br />listed in the preVious paragraph hereof, and <br />, <br /> <br />WHEREAS, said contingencies have now been s,atisfied, <br />
