<br />, <br /> <br />Department recites and warrants that: <br /> <br />1. <br />2. <br /> <br />It has authority to enter into this Agreement. <br />It has necessary personnel. facilities. equipment and <br />training to provide an adequate and reasonable degree <br />of fire protection within the fire service area. <br /> <br />. <br /> <br />SECTI ON 5 <br />Term <br /> <br />The term of this Agreement shall be for a period of five (5) years <br />commencing on July 1. 1977 and terminating June 30. 1982. unless terminated <br />by mutual consent of the parties or pursuant to other provisions of this <br />Agreement. <br /> <br />Negotiations for a continuance of this contract. or a succeeding <br />contract shall commence no later than the beginning of the fifth (5th) <br />year in the term of this contract. <br /> <br />SECTION 6 <br />Fire Service <br /> <br />Department agrees to furnish fire protection to all property within <br />the fire service area subject to the following conditions: <br /> <br />A. Reasonable Efforts. Department agrees that reasonable efforts <br />will be made to attend all fires within the fire service area whenever <br />it is notified of such flres, and that such service shall be promptly <br />rendered. provided equipment and personnel are not being used for fire <br />service protection elsewhere at the time a fire call is received. In <br />such event. equipment and personnel will respond as soon as possible <br />within the judgment of the Department's fire chief or other officer in <br />charge. which shall be final. <br /> <br />8. Apparatus. Department shall be maintained as a fully equipped <br />volunteer fire department, having the necessary personnel, equipment and <br />firefighting apparatus to meet the fire service requirements of this <br />contract. <br /> <br />C. Dispatching. Department shall send such equipment, apparatus <br />and personnel as shall in the judgment of its fire chief or other officer <br />in charge be required to meet the protection needs of the situation. <br />consistent with its other commitments. <br /> <br />. <br /> <br />SECTION 7 <br />Organization <br /> <br />Oepartment shall at all times remain a nonprofit corporation under <br />Minnesota Statutes Chapter 317. It shall be operated exclusively to <br />combat fires. prevent fires and perform related rescue work. and will <br />provide relief and retirement benefits to its members, either through <br />the by-laws of its corporation or through the by~laws of a separate <br />corporation organized for such purpose under Minnesota law. Department <br />shall at all times be in compliance with such equipment. personnel and <br />training standards as may be required by the laws of the State of Minnesota. <br /> <br />-?- <br />
