<br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF ARDEN HILLS <br /> <br />RESOLUTION NO. 77-41 <br /> <br />A RESOLUTION AUTHORIZING RECOVERY OF <br />INDUSTRIAL STRENGTH CHARGES AND PAYMENT <br />TO METROPOLITAN WASTE CONTROL COMMISSION <br /> <br />. <br /> <br />WHEREAS, the Arden Hills City CouncIl at Its meeting on <br />Apri I 25, 1977, declIned to adopt an ordinance establishing <br />an industrial user strength charge, which was a model ordInance <br />proposed for adoption by the Metropolitan Waste Control Commission <br />In conjunction with a Joint Powers Agreement and Industrial <br />contract, and <br /> <br />WHEREAS, the Arden Hills City Council at Its meeting on <br />June 27, 1977, opted not to pass an ordinance with a similar <br />objective, drafted by Its City Attorney, because the City's <br />existing Ordinance No. 49, as amended by Ordinance No. 195, <br />permits the City Councl I, by Resolution, to Impose an Industrial <br />strength user charge, and <br /> <br />WHE REAS, the Arden H I I Is City Counc I I I s des i rous of coopera- <br />ting with the MetropolItan Waste Control Commission In recovering <br />Industrial user strength charges from Industrial users of the <br />Metropoll~an Disposal System whose facilities are located within <br />the boundaries of the City of Arden HI lis and to pay those charges <br />over to the Metropolitan Waste Control Commission. <br /> <br />NOW THEREFORE, BE IT HEREBY RESOLVED by the City Councl I <br />of the City of Arden Hills that the City of Arden Hills wI II <br />estab n sh an I ndustr I a I strength use r cha rge--by Reso I ut I on <br />adopted by Its City Councl I--upon being informed by the Metropolitan <br />Waste Control Commission the exact amount of such charge, or a basis by <br />which such charge can be easily ascertained by City officials, <br />which Resolution wi I I provide for the City's payment of the charges <br />collected from the industrial users to the Metropolitan Waste <br />Control Com~lsslon at Intervals reasonably convenient as determined <br />by the City. <br /> <br />BE IT FURTHER RESOLVED, that the Clerk-Administrator of the <br />City of Arden HII Is Is hereby authorized and directed to provide <br />the Metropolitan Waste Control Commission with a certified copy <br />of this Resolution. <br /> <br />Passed by the City Council of the City of Arden HI lis this <br />25th day of July, 1977. <br /> <br />. <br /> <br />~t <br /> <br />l1enryJ. r ,Jr.'-'" <br />Mayor <br /> <br />Attest: <br /> <br />~-4 /.at; IiJJo ~~A '~ <br />Charlotte McNlesh <br />Clerk-Administrator <br /> <br />i <br />, <br /> <br />J <br /> <br />.-, <br /> <br />, <br />,.. <br />
