CONSENT ITEM — 8B <br />,-iIZEN HILLS <br />MEMORANDUM <br />DATE: September 11, 2023 <br />TO: Honorable Mayor and City Councilmembers <br />Dave Perrault, City Administrator <br />FROM: Julie Hanson, Assistant to the City Administrator/City Clerk <br />SUBJECT: Welsch's Big Ten Tavern Liquor License <br />Budgeted Amount: Actual Amount: Funding Source: <br />Council Should Consider <br />Motions to approve, table, or deny the following: <br />• On -sale and Sunday sales liquor licenses for Welsch's Big Ten Tavern (Big Ten) located at <br />4703 Highway 10 for the period of September 24, 2023 through December 31, 2023. <br />Background <br />The City was notified by an attorney representing the Welsch family that John "Jack" Welsch of the <br />Big Ten passed away in June. State Statute 340A.410, Subd. 3 states "In the case of the death of a <br />retail licensee to sell alcoholic beverages, the personal representative is authorized to continue <br />operation of the business for not more than 90 days after the death of licensee." Staff received a <br />document appointing a personal representative and notified the Minnesota Department of Public <br />Safety Alcohol and Gambling Enforcement Division (AGED) about such. The 90 day grace period <br />ends September 23, 2023. <br />The business is required to submit new application materials for a license that will cover the period <br />following expiration of the 90 day grace period through the end of this year. Staff received copies of <br />documents submitted to the Secretary of State's office for the business and also a document showing <br />designation by the personal representative of Corporate Officers James Welsch and Kim Nelson, who <br />are applying for the liquor license on behalf of the business. Please note that staff has also worked <br />closely with our City Attorney throughout this process. <br />The City has received the necessary liquor license application materials (City application, State <br />application, background check authorization forms and a Certificate of Insurance). Background <br />checks were conducted on the two applicants by the Ramsey County Sheriff's office and results were <br />satisfactory. <br />Page 1 of 2 <br />
