<br />A RESOLUTION VACATING PORTIONS OF STATE TRUNK
<br />HIGHWAY No. 51 RIGHT-OF-WAY LYING EASTERLY OF
<br />RIDGEWOOD ROAD, WESTERLY OF SNELLING AVENUE,
<br />AND SOUTHERLY OF LAKE JOHANNA BOULEVARD AND
<br />U. S. HIGHWAY No. 10
<br />
<br />WHEREAS, the Arden Hills City Council by Resolution No.
<br />79-54, passed on September 24, 1979, initiated proceeding under
<br />Section 412.851 of Minnesota Statutes, as amended, to determine
<br />whether it would be in the public interest to vacate all or any
<br />part of that portion of State Trunk Highway No. 51 lying easterly
<br />of Ridgewood Road, westerly of Snelling Avenue, and southerly of
<br />Lake Johanna Boulevard and U. S, Highway No. 10 which is des-
<br />cribed in Exhibit nAn attached to said Resolution, and
<br />
<br />WHEREAS, the Clerk-Administrator of the City of Arden
<br />Hills published in the New Brighton Bulletin on January 10, 1980
<br />and January 17, 1980 a Notice of Public Hearing on the proposed
<br />vacation of said portions of. State Trunk Highway No. 51 and also
<br />caused copies of said Notice of Public Hearing to be posted for
<br />a period of at least two (2) weeks, commencing January 10, 1980,
<br />at the Arden Hills City Hall, Tony Schmidt Park, and the Penny's
<br />Supermarket at Arden Plaza, three of the most public places in
<br />the City of Arden Hills, and
<br />
<br />WHEREAS, a public hearing before the City Council was con-
<br />ducted on Monday, January 28, 1980 and continued on March 10,
<br />1980, and
<br />
<br />WHEREAS, the City Council, after the close of the public
<br />hearing on March 10, 1980, unanimously deemed it to be in the
<br />public interest to vacate that portion of the State Trunk Highway
<br />No. 51 right-of-way shown on the Georgi-Schmidt & Assoc;,'Inc.
<br />survey of December 12, 1979 which lies north of a line perpendicular
<br />to Snelling Avenue beginning at the arc on Ridgewood Avenue as
<br />such line is sketched on said survey and dated March 10, 1980,
<br />subject to preparation of a legal description thereof by Georgi-
<br />Schmidt & Assoc., Inc., and
<br />

<br />WHEREAS, by survey dated April 25, 1980 and revised on
<br />June 11 and June 19, 1980, the City Council has now been given a
<br />legal description which satisfactorily complies with its decision
<br />on March 10, 1980,
<br />
<br />NOW, THEREFORE, BE IT HEREBY RESOLVED, by the City Council
<br />of the City of Arden Hills, four-fifths (4/5ths) of the members of
<br />the Council--namely, Mayor Crepeau and Councilmen Hanson, Woodburn
<br />and Crichton--voting in favor of this Resolution, that it is in
<br />the public interest of the City of Arden Hills to vacate the por-
<br />tions of State Trunk Highway No. 51 hereinafter described.
