We have agree- <br />ments with them on a pro-rata basis, which is an equally divided <br />basis, as we have with Shoreview for their run-off. There's two <br />percentages (inaudible) that Shoreview is contributing to it <br />because of the expense of taking out their water - a total of <br />some hundreds of thousands of dollars. There's a cubic foot <br />run-off basis for each of the areas and agreements have already <br />been made. <br /> <br />COUNCILMAN McALLISTER: I would like to ask the attorney - <br />instead of $2750 per acre, do you have another number in mind? <br />If so, what? <br /> <br />MR. STEILEN: I do not have another number in mind because . . . <br /> <br />COUNCILMAN McALLISTER: Thank you. <br /> <br />MR. STEILEN: Can I finish? <br /> <br />COUNCILMAN McALLISTER: It seems to me that that's what we <br />want to do - consider another number - but if you don't have one <br />then <br /> <br />. <br /> <br />MR. STEILEN: Can I just ask one question, because one part <br />of our objection really hasn't been addressed and then we can end <br />it - that is the point that was made that the south end of the <br />park, south of the freeway, was already adequately drained. It <br />was the north part that was not adequately draining. So to say <br />that the south has contributed and caused the prOblems is a <br />mystery to us. An honest mystery. I'm not saying it isn't <br />adequate as much as someone trying to explain the position of <br />the landowners. We honestly believe that we had adequate drainage. <br />Our problems - if you call them that - our needs were serviced by <br />what we had. The sewer facility that we had only became inadequate <br />for purposes of draining the land north of the freeway. That's <br />why we have taken the position that our property hasn't changed. <br />The value hasn't changed. It was adequately drained before and <br />it's adequately drained now. That's the basic reason we're here <br />tonight. We feel that in order to serve the property north of <br />the freeway, we have ended up being assessed. It really doesn't <br />answer the question or address the issue to say that the rainfall <br />per square foot is the same - you're obviously right - it is the <br />same. The question we have is - we were adequately serviced <br />before, nothing's changed, from our standpoint - although the <br />north is better served now - we're not better served. We don't <br />believe, without reason, that our property values have increased <br />and, if our property values haven't increased, I don't believe <br />that the assessment is justifiable under law. <br /> <br />MAYOR WOODBURN: Mr. Christoffersen (inaudible). <br /> <br />MR. CHRISTOFFERSEN: There might be some benefit in reviewing <br />the presentation I made in the past on what happened. I might <br />add - this is Lexington Avenue and this is Shoreview. Previously, <br />all the drainage north of 694 found its way down, from both sides <br />of 694, to the Lexington/694 interchange and then drained southerly <br /> <br />17 <br />
