<br />STATE OF MINNESOTA <br /> <br />COUNTY OF RAMSEY <br /> <br />CITY OF ARDEN HILLS <br /> <br />RESOLUTION NO. <br /> <br />d'/- 1,0 <br /> <br />. <br /> <br />A RESOLUTION AUTHORIZING RELEASE OF COUNTY ROAD E <br />ROADWAY AND UTILITY EASEMENT <br /> <br />WHEREAS, the City of Arden Hills (the "City") has for <br />fourteen (14) years been the holder of a perpetual roadway and <br />utility easement created in an instrument dated May 8, 1967 and <br />recorded in the office of the Ramsey County Register of Deeds on <br />October 2, 1967 in Book 2093, Ramsey County Records, Page 640 as <br />Document No. 1708908 which encumbers the South 50 feet of the <br />North 93 feet of the following described parcel of land owned by <br />DeCoster Company ("DeCoster"), a Minnesota corporation: <br /> <br />The North 268 feet of the West 148 feet of the East <br />495 feet of the Northwest 1/4 of the Northeast 1/4 <br />of Section 34, Township 30 North, Range 23 West, <br />Ramsey County, Minnesota, subj ect to an easement <br />for road purposes over the North 43 feet thereof <br />and subject to an easement for ingress and egress <br />over the West 41 feet thereof, and <br /> <br />WHEREAS, DeCoster is selling said parcel of land to a <br />third party, and both DeCoster and the third party wish said <br />parcel to be released from said easement, and <br /> <br />WHEREAS, the City has never used the easement for the <br />purposes intended and granted and there is no longer any reason <br />for said easement, <br /> <br />NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council <br />of the City of Arden Hills that the aforesaid easement be <br />released and extinguished and that the Mayor and Clerk- <br />Administrator be authorized and directed to execute an instrument <br />releasing and extinguishing the easement. <br /> <br />BE IT FURTHER RESOLVED, that the Clerk-Administrator be <br />and she hereby is authorized and directed to furnish certified <br />copies of this Resolution to DeCoster and to the third party <br />purchasing DeCoster's parcel. <br /> <br />. <br /> <br />p~/passed ~ the C~ty Council of the City of Arden Hills this <br />~o~day of~ ,198/. <br /> <br />o:?~-;oer:)~~ <br /> <br />Attest: <br /> <br />CZWatt(fJ}~ <br /> <br />Charlotte McNiesh, <br />Clerk-Administrator <br />
