<br />-l <br />I <br /> <br />STATE OF MINNESOTA <br /> <br />COUNTY OF RAMSEY <br /> <br />CITY OF ARDEN HILLS <br /> <br />RESOLUTION NO. 81-79 <br /> <br />. <br /> <br />A RESOLUTION AUTHORIZING MAYOR AND CLERK-ADMINISTRATOR <br />TO EXECUTE PIPE LINE CROSSING PERMIT OF <br />TRI-STATE LAND COMPANY AND SOO LINE RAILROAD COMPANY <br />IN CONNECTION WITH 1-694 AND LEXINGTON AVENUE <br />STORM DRAINAGE PROJECT <br /> <br />WHEREAS, the City of Arden Hills (the "City") needs <br />permission from Tri-State Land Company and the Soo Line Railroad <br />Company (the "Railroad") to install, maintain, operate and repair <br />a storm sewer pipe not exceeding sixty (60) inches in diameter at <br />a depth of not less than fourteen (14) feet below the base of <br />railroad tracks owned by the Railroad in connection with the Grey <br />Fox Road segment of the 1-694 and Lexington Avenue storm drainage <br />project. and <br /> <br />WHEREAS, the Railroad has indicated its willingness to <br />grant the City such permission provided the City signs the. <br />Railroad's Pipe Line Crossing Permit No. 22980 (the "Permit"), <br />and <br /> <br />WH~REAS, the City is amenable to the terms and conditions <br />of the Permit as modified by the deletion in the first sentence <br />of Paragraph No.2 of that clause which appears immediately after <br />the phrase". . . for the permission herein granted" in the second. <br />line of said first sentence of Paragraph 2, and further modified <br />so that Paragraph No. 13 reads "The Railroad Company shall not 'b'e <br />required to assume any portion of the cost of future maintenance <br />of said pipe line". <br /> <br />NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council <br />of the City of Arden Hills that the Permit is hereby approved and <br />the Mayor and Clerk-Administrator are hereby authorized to execute <br />the same and to cause a certified copy of this Resolution to be <br />forwarded to the Railroad along with the original and one copy <br />of the P$J'Wlit. <br /> <br />. <br /> <br />BE IT FURTHER RESO~VED, that the City ireasureT is hereby <br />authorized to issue a check in the amount of $1$0.00 to the <br />e . t <br />Railroad to defray the cost of preparing the liCense (i.e.. <br />$100,00) and the annual rental of $10.00 per annum (billed on a <br />fivecyear basis) forethe period of October 27, 1981 to October <br />27, 1986 and that the Clerk-Administrator is hereby authorized <br />to forward the check in the aum of $1$0.00 to the Railroad along <br />with the certified copy Of this Resolution and tile originaL and <br />one copy of the Permit. <br /> <br />Passed by thll Arden Hills City Council.thi. 9'tiI. day <br />of November . .981. <br /> <br />....,,"""7 <br /> <br />;{' P/~*-.//'?7.u~wv <br />Rohert L.
