<br />. <br /> <br />4 <br /> <br />. <br /> <br />.. <br /> <br />\ <br /> <br />STATE OF MINNESOTA <br /> <br />COUNTY OF RAMSEY <br /> <br />CITY OF ARDEN HILLS <br /> <br />RESOLUTION No. 81-69 <br /> <br />A RESOLUTION DECRYING LACK OF NOTICE TO PROPERTY OWNERS <br />OF PROPERTIES NEAR A PROPOSED RESIDENTIAL FACILITY <br />FOR THE HOUSING OF MENTALLY HANDICAPPED PERSONS <br /> <br />WHEREAS, the City of Arden Hills was duly notified by the <br />Minnesota Department of Public Welfare of the proposed use of <br />1385 Cummings Lane in Arden Hills as a group home for mentally <br />handicapped young adults pursuant to Section 245.821, and <br /> <br />WHEREAS, the City of Arden Hills mistakenly assumed that <br />the Department of Public Welfare would also provide written <br />notice to the owners of properties located within a 350 foot <br />radius of 1385 Cummings Lane so that they could participate in <br />the determination by the Department of whether the residence at <br />1385 Cummings Lane would be suitable for group home purposes, and <br /> <br />WHEREAS, A.C.R. Homes, Inc., the applicant for a license <br />to operate the group home at 1385 Cummings Lane, did not notify <br />any of the owners of properties in proximity to 1385 Cummings <br />Lane of the various hearings before the Department of Public <br />Welfare, Metropolitan Council and the Ramsey County Board which <br />were necessary in order for it to receive a license to operate a <br />group home at 1385 Cummings Lane, and <br /> <br />WHEREAS, the neighbors of 1385 Cummings Lane--because of <br />the lack of notice not only from the City of Arden Hills but also <br />from the Department of Public Welfare, the Ramsey County Board <br />and Metropolitan Council--have been effectively stripped of any <br />voice in the determination of whether or not 1385 Cummings Lane <br />and the neighborhood within which it is located are suitable for <br />a group home, <br /> <br />NOW, THEREFORE, the City Council of the City of Arden <br />Hills--by unanimous vote of all of the Council members--does <br />hereby decry its own failure and the failure of the Department of <br />Public Welfare, the Ramsey County Board and Metropolitan Council <br />to provide written notice to the owners of properties located in <br />proximity to 1385 Cummings Lane of the proposed use and licensing <br />thereof as a group home for mentally handicapped young adults and <br />hereby sincerely requests that the Department of Public Welfare, <br />Ramsey County Board and Metropolitan Council--in the future-- <br />notify the owners of properties within a 350 I radius of the <br />property proposed to be devoted to group home purposes of any <br />hearings to be conducted by such agency with respect to such <br />proposed use. <br /> <br />BE IT FURTHER RESOLVED, that the Clerk-Administrator be <br />and she hereby is authorized and directed to provide certified <br />copies of this Resolution to the Department of Public Welfare, <br />Ramsey County Board and Metropolitan Council and any other <br />agencies involved in the decision-making process with respect to <br />not only group homes for mentally handicapped but also group <br />homes for physically disabled, mentally ill, chemically or <br />
