<br />Page 2 of 3 <br /> <br />definition aligns with other filling and excavation definitions in Section 1325.08 and Chapter 15. <br />The Public Works Director/City Engineer reviewed the proposed definition and found it to be <br />consistent with Grading and Erosion control definitions. <br /> <br />Section 1325.08 Filling and Excavation <br />The proposed ordinance amendments to Section 1325.08 would strike language that is inconsistent <br />with Section 1510.01 as well as duplicative language that is addressed in greater detail within that <br />section. Proposed amendments would also add language that references Chapter 15 explicitly and <br />update numeric values to be consistent with Section 1510.01. Additional language would clarify <br />at what threshold of filling or excavation a conditional use permit is required. The Public Works <br />Director/City Engineer reviewed the proposed ordinance amendments for consistency and <br />alignment with industry best management practices. <br /> <br />Section 1510.01 Definitions <br />While reviewing Section 1325.08 Filling and Excavation, city staff considered possible <br />amendments to Chapter 15 Grading and Erosion Control for improved consistency with best <br />practices. The proposed ordinance amendment would modify the definition for Land Disturbance <br />Activity, striking values that are inconsistent with current practices and updating them with <br />accurate values as well as adding language to clarify the types of activities that are considered a <br />Land Disturbance Activity. <br /> <br />Section 1520.03 Escrow Requirement <br />The proposed ordinance amendments include a modification to the escrow requirements described <br />in Chapter 15. The drafted amendment includes language to clarify how Grading and Erosion <br />Control escrows will be utilized and to establish a timeline for the return of unused escrow funds. <br /> <br />Additional Review <br /> <br />Public Works/Engineering <br />Staff worked with the Public Works Department to draft the proposed ordinances. Upon review of <br />the final draft of the proposed ordinance amendments, no further comments were made. <br /> <br />Findings of Fact <br /> <br />The Planning Commission must make a finding as to whether or not the proposed amendments <br />would adversely affect the surrounding neighborhood or the community as a whole based on the <br />aforementioned factors. Staff offers the following findings for consideration: <br /> <br />General Findings: <br />1. The City of Arden Hills is proposing to amend ordinance language to make filling and <br />excavation quantities, activities, and permitting processes consistent across the City <br />Code. <br />2. The proposed ordinance will include amendments to the language of Chapter 13 – Zoning <br />Code, Sections 1305.04 – Definitions and 1325.8 – Filling and Excavation and Chapter <br />15 – Grading and Erosion Control, Section 1510.01 – Definitions and 1530.03 – Escrow <br />Requirements. <br />3. The proposed ordinance amendments were reviewed and supported by the Public Works <br />Director/City Engineer.
