CONSENT ITEM— 8H <br /> ,-AI�EN HILLS <br /> MEMORANDUM <br /> DATE: November 13, 2023 <br /> TO: Honorable Mayor and City Councilmembers <br /> Dave Perrault, City Administrator <br /> FROM: Jessica Jagoe, Community Development Director <br /> SUBJECT: 1861 Highway 96 West- Variance Extension <br /> Budgeted Amount: Actual Amount: Funding Source: <br /> N/A N/A N/A <br /> Council Should Consider <br /> Motions to approve, table, or deny the following: <br /> • A 180-day extension until May 15, 2024, for the variance expiration at 1861 Highway 96 <br /> W. <br /> Background <br /> On December 19, 2022, the City Council approved Planning Case 22-022 from Katie Bach and <br /> Nate Cmiel for a variance for the property located at 1861 Highway 96 W. The Applicants had <br /> requested a front yard setback variance for future demolition and redevelopment of a single- <br /> family residential dwelling on the Subject Property. To construct the proposed single-family <br /> dwelling, the Applicants requested a reduced front yard setback of 28 feet rather than 40 feet as <br /> required by the city code. <br /> Under Section 1355.06, Subd. 3, a variance shall automatically expire and become void one year <br /> from and after the date on which the City Council granted such approval if the building permit or <br /> other approved improvements have not been issued a permit by the building inspector. The City <br /> Council may extend the expiration date of such approval upon written application by the person <br /> to whom the approval was granted. Based on the variance approval date, the deadline for <br /> issuance of a permit would be December 18, 2023. <br /> On October 25, 2023, the Applicants submitted a request to the City requesting a 180-day <br /> extension until May 15, 2024, due to the timing of the contractor selection process and securing <br /> financing. The Applicants have begun submitting plans and other information needed for the <br /> issuance of a building permit, but they may not have all of the items finalized prior to the one <br /> year deadline as required for the variance. <br /> Page 1 of 2 <br />
