NEW BUSINESS ITEM— 11A ,-AI�EN HILLS MEMORANDUM DATE: November 13, 2023 TO: Honorable Mayor and City Councilmembers Dave Perrault, City Administrator FROM: Julie Hanson, Assistant to the City Administrator/City Clerk SUBJECT: Ordinance 2023-012 Amending Chapter 3, Section 350 of the Arden Hills City Code Regarding Tobacco Products Budgeted Amount: Actual Amount: Funding Source: N/A N/A N/A Council Should Consider Motions to approve, table, or deny the following: Ordinance 2023-012 Amending Chapter 3, Section 350 of the Arden Hills City Code Regarding Tobacco Products and Authorization to Publish a Summary Ordinance The Ordinance amendment requires a simple majority,for•action. The Summary Ordinance requires a 415 vote. Back6round/Discussion The City Council previously directed staff to work with the City Attorney to clarify language in City Code regarding the sale of flavored tobacco products, specifically pertaining to synthetic nicotine products and prohibiting their sale in the City. Please see Attachment A for the redlined draft proposed language amending Chapter 3, Section 350 and Attachment B (clean version) which addresses synthetic nicotine and provides for other minor housekeeping changes. Staff is requesting Council consider approval of Ordinance 2023-012 and authorize staff to publish a Summary Ordinance (Attachment C). Please note City Attorney Jack Brooksbank will be in attendance at this meeting for questions. In addition, a letter dated October 9, 2023, was mailed to the six businesses that hold a tobacco license in Arden Hills (Brausen Holiday, Arden Hills Tobacco, Cub Foods, Cub Discount Liquor, Holiday Stationstore and Walgreens). The letter informed the licensees that the City Council would be considering this amendment at its November 13, 2023 meeting and invited the businesses to provide comment.
