<br />STATE OF MINNESOTA <br /> <br />COUNTY OF RAMSEY <br /> <br />CITY OF ARDEN HILLS <br /> <br />RESOLUTION No. f/-Jf <br /> <br />-. <br /> <br />RESOLUTION INITIATING VACATION OF <br />SERVICE DRIVE ADJACENT TO HAMLINE AVENUE NORTH <br />LYING SOUTH OF THE WESTERLY TERMINUS OF <br />TILLER LANE PURSUANT TO SECTION 412.851 OF <br />MINNESOTA STATUTES, AS AMENDED <br /> <br />WHEREAS, Section 412.851 of Minnesota Statutes, as <br />amended, permits a municipal council to initiate a proceeding to <br />vacate any street, alley, public grounds, public way, or any part <br />thereof, and <br /> <br />WHEREAS, the City Council of the City of Arden Hills <br />desires to determine whether it would be in the public interest <br />to vacate the service road lying easterly of and adjacent to <br />Hamline Avenue North and southerly of the westerly terminus of <br />Tiller Lane, <br /> <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of the <br />City of Arden Hills, a quorum thereof being present, a proceeding <br />pursuant to Section 412.851 of Minnesota Statutes, as amended, be <br />and it hereby is initiated in order to determine whether it would <br />be in the public interest to vacate the service road described in <br />the second recital hereof. <br /> <br />BE IT FURTHER RESOLVED, that the City Engineer be and he <br />hereby is authorized and directed forthwith to prepare the <br />necessary legal description of the aforedescribed service road. <br /> <br />BE IT FURTHER RESOLVED, that the Clerk-Administrator and <br />the City Attorney, after the City Attorney I s receipt of the <br />aforesaid legal description from the City Engineer, be and they <br />hereby are authorized to cause a notice of a public hearing to <br />determine the public interest in said vacation to be published in <br />the New Brighton Bulletin and to be posted in at least three (3) <br />of the most public places in the City, for at least two (2) weeks <br />prior to the date of said public hearing, all in accordance with <br />the provisions of Section 412.851 of Minnesota Statutes, as <br />amended. <br /> <br />BE IT FURTHER RESOLVED, that the Clerk-Administrator be <br />and she hereby is authorized and directed to cause certified <br />copies of this Resolution to be served upon those owners of <br />properties abutting the aforedescribed service road. <br /> <br />"e <br /> <br />9__/ Passed by the City Council of the City of Arden Hills this <br />&~ day of June, 1981. <br /> <br />f~~ <br /> <br />Robert L.
