Staff has prepared a draft ordinance identifying language to be added for the City Council's review. <br />The proposed ordinance amendments would bring Chapter 13 and Chapter 15 into alignment with <br />processes and procedures for the movement of soil. <br />The applicable Sections to be amended are as follows: <br />• Section 1305.04, Zoning Code Definitions <br />• Section 1325.08, Filling and Excavation <br />• Section 1510.01, Erosion and Sediment Control Definitions <br />• Section 1520.03, Escrow Requirement <br />Proposed Ordinance Language: <br />1) Add a definition for Land Reclamation <br />2) Amend Section 1325.08 Filling Excavation to be consistent with Chapter 15 <br />a. Strike language that is inconsistent with Section 1510.01 as well as duplicative <br />language that is addressed in greater detail within that section. <br />b. Add language that references Chapter 15 explicitly and update numeric values to <br />be consistent with Section 1510.01. <br />c. Add language to clarify at what threshold of filling or excavation a conditional use <br />permit is required. <br />3) Amend Section 1510.01 Definitions to align with industry best practices <br />a. Modify the definition for Land Disturbance Activity <br />i. Strike values that are inconsistent with current practices and update them <br />with accurate values. <br />ii. Add language to clarify the types of activities that are considered a Land <br />Disturbance Activity. <br />4) Amend Section 1520.03 Escrow Requirements to clarify how Grading and Erosion <br />Control escrows will be utilized and to establish a timeline for the return of unused escrow <br />funds. <br />Planning Commission Review <br />The Planning Commission reviewed this application at the November 8, 2023 meeting. The <br />Commission voted 6-0 (Commissioner Collins was absent) to recommend approval of Planning <br />Case 23-019. <br />Notice <br />A Zoning Code Amendment requires a public hearing. Notice was published in the Pioneer <br />Press on November 16, 2023.
