1305.04 Definitions
<br />drainage area less than two (2) square miles shall be regulated for the purposes of these
<br />regulations.
<br />• Public use. The use of any lot, parcel of land and any structure or building thereon
<br />exclusively for public purposes by any department or branch of government, federal, state,
<br />county or city, excluding independent school districts, without reference to the ownership
<br />of said lot, parcel of land, building or structure.
<br />• Public waters. Means a body of water capable of substantial beneficial public use. This
<br />shall be construed to mean, for the purposes of these regulations, any body of water, which
<br />has the potential to support any type of recreational pursuit or water supply purpose. A
<br />body of water created by a private user where there was no previous shoreland, as defined
<br />herein, for a designated private use authorized by the commissioner of natural resources,
<br />shall be exempt.
<br />• Railroad right-of-way. A strip of land with tracks and auxiliary facilities for track
<br />operation, but not including depots, loading platforms, station, train sheds, warehouses, car
<br />shops, car yards, locomotive shops or water towers.
<br />• Reach. A hydraulic engineering term to describe a longitudinal segment of a stream or
<br />river influenced by a natural or man-made obstruction. In an urban area, the segment of a
<br />stream or river between two consecutive bridge crossings would most typically constitute
<br />a reach.
<br />• Recreation, commercial. Recreational facilities which are operated for profit or render
<br />a service which is customarily considered as a business.
<br />• Recreation, residential. Play apparatus such as swing sets and slides, sandboxes, poles
<br />for nets, picnic tables, lawn chairs, barbecue stands, and similar equipment or structures,
<br />when used on residential property, but not including electronic towers, tree houses,
<br />swimming pools, playhouses exceeding twenty-five (25) square feet of floor area, or sheds
<br />utilized for storage of equipment.
<br />• Recreational vehicles (RVs). Vehicles for recreational or utilitarian uses that can be
<br />driven, towed, or hauled. Including, but not limited to, motor homes and travel trailers,
<br />snowmobiles, pull campers, all terrain vehicles (ATVs), tent trailers, or other similar
<br />vehicles. (revised 02/07/08)
<br />• Recreational vehicles (for the purposes of Section 1335 only). A vehicle that is built on
<br />a single chassis, is 400 square feet or less when measured at the largest horizontal
<br />projection, is designed to be self-propelled or permanently towable by a light duty truck,
<br />and is designed primarily not for use as a permanent dwelling but as temporary living
<br />quarters for recreational, camping, travel, or seasonal use. For the purposes of Section
<br />1335, the term recreational vehicle shall be synonymous with the term travel trailer/travel
<br />vehicle. (added 05/05/10)
