Attachment E <br />PC Agenda Item — 3B <br />,`iRZEN HILLS <br />MEMORANDUM <br />DATE: November 8, 2023 <br />TO: Planning Commission Chair and Commissioners <br />FROM: Elena Fransen, Senior Planner <br />SUBJECT: Planning Case #23-019 — Public Hearing Required <br />Applicant: City of Arden Hills <br />Request: City Code Amendments — Chapter 13, Filling and Excavation and <br />Chapter 15, Erosion and Sediment Control <br />Requested Action <br />The City of Arden Hills is proposing amendments to the City's Zoning Code Chapter 13 and <br />Erosion and Sediment Control Chapter 15. Proposed amendments would strike and add language <br />to standardize the permitting requirements for filling and excavation as well as the types of <br />activities that shall be allowed. The proposed amendments to City Zoning Code Chapter 13 and <br />Chapter 15 are within the following Sections: <br />• Section 1305.04, Zoning Code Definitions <br />• Section 1325.08, Filling and Excavation <br />• Section 1510.01, Definitions <br />• Section 1520.03, Escrow Requirement <br />Background <br />At the April 17, 2023 City Council work session, it was identified that Section 1325.08 Filling and <br />Excavation in the Zoning Code contained language that was inconsistent with Section 1510.01 <br />Erosion and Sediment Control. Council directed staff to update inconsistent language in the <br />ordinance on the amount of land disturbance and fill that can occur on a property triggering a <br />permit. Staff were directed to work with the Public Works Director/City Engineer to review the <br />Filling and Excavation section of the Zoning Code as the section is similar to the Erosion and <br />Sediment Control standards of the City Code. <br />Overview of Ordinance Amendments <br />Section 1305.04 Definitions <br />The proposed ordinance amendment to Section 1305.04 Definitions is adding a definition for "land <br />reclamation" as this term is referenced in Section 1325.08 Filling and Excavation.
