<br />ARDEN HILLS CITY COUNCIL - JULY 9, 2001 <br /> <br />2 <br /> <br />. <br /> <br />stated the language allows the issue to be addressed if needed. She noted she wanted to make <br />sure as they move forward they would not lose section 12-30. She added that needed to be <br />validated that with the DNR. <br /> <br />Mr. Steve Nelson, 3475 Siems Court, stated he had previously sent a letter with his issues. He <br />noted the issue was would they have the right to place buoys whether the language was in the <br />ordinance or not. He added it was in the DNR regulations. He stated he would like the Council <br />to consider whether they are complying with state requirements on changing the setbacks. He <br />noted it was confusing for people that they are one ofthe few lakes, which have a 250-foot <br />setback. He added he would like the Council to consider changing the 250 feet back to 150 feet, <br />which the DNR would allow. He stated that it would be less confusing for those using the lake <br />and would give them a more usable area of the lake. He noted it would also be safer. <br /> <br />Mr. Dan Kuechmeister, 3372 Lake Johanna Boulevard, stated he was not sure why anyone would <br />want to change from 250 to 150 when no one was enforcing the 150 feet. <br /> <br />Ms. Lisa Abraham, 3511 Siems Court, stated it would be nice if it was enforceable in the <br />swimming area. She noted her children were almost run over an hour ago 10 feet off her dock. <br />She added she would like not to have to be concerned about her children swimming near their <br />property. <br /> <br />As no one else wished to speak, Mayor Probst closed the public hearing at 7:50 p.m. <br /> <br />. Councilmember Aplikowski stated there were two requests for buoys for the swim areas. She <br />asked how they would be marked other than the City requiring buoys. Ms. Hansen responded <br />the homeowners could buoy their swim areas now. She stated if they had a source or supply for <br />buoys, then the homeowner could mark the area himself or herself. She noted that in some of the <br />lake bays, boats get close. She added marking swimming areas would be of minimal cost to the <br />lake property owner and easily complied with. <br /> <br />Councilmember Aplikowski stated the correspondence from one resident said safety required <br />more policing. She asked if Ramsey County Patrol Officers were out there on the lake. Ms. <br />Hansen responded the Ramsey County Water Patrol does patrol out on the lake. She stated they <br />do an incredible job. She noted they respond promptly after being called. She added there used <br />to be a citizen patrol. She stated she did not think the response time had ever been longer than 10 <br />minutes on a call. <br /> <br />MOTION: <br /> <br />Councilmember Aplikowski moved and Councilmember Grant seconded a motion <br />to approve Ordinance 330, an Ordinance relating to Lake Surface Use <br />Regulations, Amending Article 2, Division 1, Section 12-16 through 12-19 and <br />Article 2, Division 2, Sections 12-27 and 12-32, and to direct staff to forward the <br />changes to the DNR for their review and approval and to publish it upon <br />acceptance by the DNR. The motion carried unanimously (4-0). <br /> <br />. <br />
