CONSENT ITEM — 8P <br />,-fl DEN HILLS <br />MEMORANDUM <br />DATE: January 8, 2024 <br />TO: Honorable Mayor and City Councilmembers <br />Dave Perrault, City Administrator <br />FROM: Jessica Jagoe, Community Development Director <br />SUBJECT: Arden Hills Corporate Center, 4255 Lexington Avenue N. — Estoppel Certificate <br />Budgeted Amount: Actual Amount: Funding Source: <br />N/A N/A N/A <br />Council Should Consider <br />Motions to approve, table, or deny the following: <br />• Estoppel Certificate for the Development Agreement of Planning Case 17-012 and <br />Parking and Access Easement at Arden Hills Corporate Center - 4255 Lexington Avenue <br />N. <br />Background <br />On May 22°d, 2017, the City Council approved Planning Case 17-012 for a Final Planned Unit <br />Development for CSM Corporation for the properties located at 4255, 4265, 4293, and 4295 <br />Lexington Avenue N. These four lots were created through subdivisions granted by the City in <br />1995 and 1999. There are a total of four existing buildings on the site, with the buildings at 4293 <br />and 4295 Lexington Avenue N. sharing a common wall. The PUD development functions as a <br />single entity with the four lots sharing common access driveways, utilities, stormwater <br />management, and parking. The project was approved with nine (9) conditions. One of those <br />conditions required the Developer to execute the City's standard PUD Development Agreement <br />prior to the issuance of any development permits. That Agreement was fully executed and <br />recorded July 13, 2017 as Document No. A04667260. <br />In addition, the City has a Permanent Parking and Access Easement for Cummings Park that was <br />filed on January 7, 1997, as Document No. 2972336. This easement grants the City permanent <br />non-exclusive rights to ingress and egress over portions of land within this PUD Development as <br />well as parking spaces for utilization in conjunction with the adjacent City park. <br />Page 1 of 2 <br />
