I
I.
I
I
I
I
I
I
I
I-
I
I
I
I
I
I
I
I-
I

ARDEN HII ,LS CITY COUNCIL - SEPlEMBER 11. 1995

4:

Mr. Ringwald believed the EA W, public comments on the EA W, and responses to those public
comments have adequately identified the environmental effects which may be reasonably expected
to occur from this 16 unit residential project. The identification of and mitigation procedures for
these environmental effects will provide the City Council sufficient information to make an informed
decision on this development proposal.

Mr. Ringwald indicated the staffwould recommend in the Environmental Assessment Worksheet
for the Townhomes of Lake Valentine that:

I. The City Council adopt the response to the public comments;
2. The City Council adopt the Findings of Fact;
3. The City Council adopt a negative declaration on the need for an EIS;
4. The City Council authorize staff to distribute the responses to the public comments;
and
5. The City Council authorize staff to distribute the decision of the City Council on the
need for an EIS.

Mayor Probst indicated this is not a Public Hearing, but the Council will allow public comment at
this time. He noted comments would be limited to three minutes, to allow the opportunity for all
who wish to speak.

Mr. Paul Rem, 1670 Glenview Court, presented the Council with information regarding drainage
and flooding on the site. He wanted the Council to be informed of the lake levels, he did not believe
the EA W addressed this issue.

Mr. Rem noted in 11 out of the last 20 years the lake level has been higher than 879.3 feet. And
also, three of the past 20 years the lake was at or above 880.6 feet.

Mr. Rem expressed concern that these facts were not addressed by agencies commenting on the
EAW because the plan included in the EAW was not the current version dated July 17,1995.
Further he indicated that the Department of Natural Resources (DNR) had reservations about the
sediment basin as shown in the earlier version of the plan, the only one upon which they could base
their comments.

Mr. Mark Chapin, 3947 Rolling Hills Road, expressed disappointment with the EA W. He felt
the information provided in the EA W was not much more than what was previously known. He
believed the EA W to be inadequate and urged the Council to postpone their decision until more
detailed information could be provided.

Mr. Chapin indicated the EA W did not address any of the concerns regarding wildlife. He noted the
addition of impervious surface at the nearby elementary school was also not addressed.
