<br />. <br /> <br />. <br /> <br />" <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />MINUTES OF THE ARDEN HILLS REGULAR COUNCIL MEETING <br />Monday, June 13, 1988, 7:30 p.m. - Village Hall <br /> <br />. <br /> <br />CALL TO ORDER <br /> <br />Pursuant to due call and notice thereof, Mayor Woodburn <br />called the meeting to order at 7:30 p.m. <br /> <br />ROLL CALL The roll being called the following members were present: <br />Mayor Robert Woodburn, Councilmembers Nancy Hansen, and <br />Gary Peck. Councilmember Jeanne Winiecki arrived at 7:35 p.m.. Absent: Thomas <br />Sather. Also present: Attorney James Lynden, Engineer Barry Peters, Planner John <br />Bergly, Public Works Supervisor Robert Raddatz, Acting Clerk Administrator <br />Charlotte McNiesh and Deputy Clerk Catherine Iago. <br /> <br />APPROVE MINUTES <br />page <br />Treasurer, <br />incorrect. <br /> <br />Acting Clerk Administrator McNiesh advised Council on <br />6 of the 5/31/88 Council Minutes, under Report of <br />Investments, the maturity dates for the investments listed were <br />McNiesh reported the following correct dates: <br /> <br />5/16/88 - $200,000.00 invested at American National, @ 7.25%, to mature 11/14/88. <br />5/16/88 - $l50,~OO.OO invested at First Minnesota, @ 7.5%, to mature 5/11/89. <br />5/31/88 - $206,320.59 invested at Twin City Federal, @ 7.46% to mature 5/26/89. <br /> <br />Peck moved, seconded by Hansen, that Council approve the <br />Minutes of the May 31, 1988 Regular Council Meeting as amended. Motion carried <br />unanimously. (3-0) <br /> <br />BUSINESS FROM FLOOR None <br /> <br />MNDOT CONSTR. UPDATE Acting Clerk Administrator McNiesh reported complaints <br />had been received relative to the traffic problems on <br />Hamline and Highway 96, due to the construction on High~ay 10. She advised a <br />representative from MNDOT was in the area this date and met with the Deputy <br />Sheriff to try to find a solution to the traffic problem. McNiesh stated she was <br />not advised if a determination was made to resolve the problem. <br /> <br />McNiesh stated there was discussion relative to placement of thru stop signs or <br />reduced speed on Highway 96 or the possibility of closing access from 1-694 to <br />Hamline, which may contribute to the problem. She advised a solution may be <br />reached this week. <br /> <br />REPORT OF ATTORNEY <br /> <br />RES. #88-16; <br />JOINT POWERS <br />AGREEMENT FOR <br />PURCH. AERIAL <br />FIRE TRUCK <br /> <br />Council was referred to the memorandum of 6-9-88 from <br />Shoreview's Attorney and the resolution drafted by <br />Attorney Lynden relative to the Joint Po~ers Agreement <br />between Arden Hills and Shoreview for purchase of the <br />aerial fire truck. Lynden recommended approval. <br /> <br />Peck moved, seconded by Hansen, that Council approve <br />Resolution No. 88-16, Approving a Joint Powers Agreement between the Cities of <br />Arden Hills and Shoreview Concerning the Purchase, Financing, Maintenance, <br />Repair, Use and Disposition of an Aerial Platform Truck to be used for Fire <br />Protection Purposes and Authorizing Mayor and Clerk Administrator to Sign the <br />Agreement. Motion carried unanimously. (4-0) <br /> <br />RES. #88-17; <br />FIRE PROTECTION <br />AGREEMENT <br /> <br />Council was referred to the resolution drafted by <br />Attorney Lynden regarding approval of the fire protection <br />agreement between Arden Hills and LJVFD. <br /> <br />Lynden advised Council he has not had the opportunity to review the proposed fire <br />contract since November of 1987 and he questioned the inclusion of the <br />compensation provision which is identified as Item No. 11 in the agreement. He <br />stated he had requested a copy of the Shoreview fire protection agreement for <br />comparison pur~ses; Shoreview's contract has a provision for "Accountability" <br />which identifies the process for mediation but does not mention arbitration. <br /> <br />. <br /> <br />Mayor Woodburn stated Shoreview personnel drafted a provision which states if the <br />LJVFD or the City fails to satisfy the requirements of their agreement a mediator <br />may determine whether or not the level of service requested by Shoreview can <br />reasonably be provided by the LJVFD for the budgeted amount. He further advised <br />that the provision states the mediator may not approve, disapprove or modify the <br />budget approved by the City of Shoreview for fire protection service. <br />
