<br /> I - <br /> ! <br /> AGREEMENT __' <br /> - <br /> - <br /> - AGREEMENT, made and entered into this day <br /> THIS <br /> - <br /> of , 19 by and between The <br /> Darling Company, Inc. , a division of Darling-Delaware, hereinafter <br /> referred to as "Company", and the CITY OF ARDEN HILLS, hereinafter <br /> referred to as the "City". <br /> WIT N E SSE T H: <br /> WHEREAS, Company has been granted a permit to operate a <br /> rendering plant for the year 1979 by the City in and by Resolution <br /> No. 79-58 on the condition that, among other things, the Company and <br /> the City execute this agreement in regard to testing of emissions <br /> into the ambient air from the Company's rendering plant facilities, <br /> . and <br /> . WHEREAS, Company is desirous of continuing its <br /> operation as a rendering plant in the City of Arden Hills during the <br /> year 1987, <br /> NOW, THEREFORE, it is hereby agreed by the parties <br /> hereto as follows: -- <br /> l. The emissions from the exhaust stack of the scrubber serving <br /> Company's rendering plant facility at 619 N.E. 14th Street, <br /> Arden Hills, Minnesota shall be tested at least twice and up <br /> to four times in each calendar year. <br /> 2 . All costs associated with the tests and reports shall be <br /> borne by and paid for by the Company. The Company shall <br /> allow the firm selected to perform the tests between the <br /> hours of 3:00 P.M, and 12:00 midnight, Monday through <br /> Friday, with no more than one hour prior notice of intent to <br /> perform said tests and shall not restrict the testing <br /> company from access to the property or facilities. <br /> . 3. The City shall select the firm contracted to perform the <br /> . test after first consulting with the Company. The date and <br /> ------ <br />
