. construction. These are the only services which the City shall perform with respect to the Developer [Project] Improvements. (2) Payment for City's Services. The City hereby requires and Developer hereby agrees to pay legal expenses incurred by the City in connection with the approval and acceptance of the plat referred to herein and the preparation of this Development Agreement in the sum of Three Hundred Fifty and nollOO Dollars ($350,00), Payment of such legal expenses is a condition precedent to the City's execution of this Development Agreement. If Developer opts to do not only the Developer Improvements but also the City Improvements (i.e., to install the entire Project), then it shall reimburse the City for all reasonable . costs incurred by the Ci ty in connection with the Project, including but not limited to costs incurred in the preparation of the Feasibility Report (e.g" the fees and costs of the City Engineer), wi thin thirty (30) days after submission to it of an invoice setting forth all of such costs, Failure of the Developer to make payment by the end of said thirty (30) day period shall constitute a defaul thereunder. Interest on any delinquent amounts shall accrue at the lesser of fifteen percent (15%) per annum or the maximum lawful rate from the date of the invoice until paid in full. All other costs incurred by the City in rendering services to Developer in connection with the Developer Improvements shall be added to the cost of the Project and assessed against all properties benefitted by . the Project.
