. 4. City Improvements. I (a) Obligation to Install City I~rovements. Developer has petitioned the Clty for the installation of the City Improvements and the City Council has or4ered the installa- tion of the City Improvements. The cost of the installation of the City Improve- ments shall be assessed in accordance with the next subsection of this Section unless the Developer opts to install them. (b) Adherence to Requirements of Chapter 429 of Minnesota Statutes. The substantive and procedural requirements of Chapter 429 of Minnesota Statutes, as amended, shall be complied with by the City in imple- menting the City Improvements. In accordance with that Chapter, the City Engineer will prepare final plans and specifications for the Project, and the contract for the installation of the City Improvements will be awarded by the City Council. Installation of the City . Improvements shall take place under the , City's complete supervision. This provision, of course, does not apply if the Developer does the City Improvements. 5. Special Assessments (Applicable Only if City Does City Improvements. (al Costs of City Improvements and City Services Incurred in Connection with Developer's Improvements Defrayed by Special Assessments. The cost of the installation of the City Improvements and for all City services incurred in connection with the Developer's Improve- ments, including all engineering, legal, right-of-way acquisition and administra- tive costs incurred by the City in connection therewith, shall be assessed against all properties benefited by the Project as provided in Chapter 429 of Minnesota Statutes, subject, however, to the following subsections of this Section 5. . (b) Special Assessment Installments. The special assessments shall be payable in equal annual installments of principal plus interest over a period of not to ~-~--, - '-- -- --~~.-
