While many aerials are <br /> attached to poles above the roofs of dwel- <br /> lings, and even to trees, the use of separate <br /> poles or masts for this purpose still prevails <br /> when a householder seeks the best reception. <br /> Such equipment is certainly customarily <br /> incident to a residential establishment." <br /> Vi llage of St. Louis Park v. Casey, supra at p. 460. <br /> Mr. Kahnke has indicated to me his intention to erect a <br /> well-engineered, structurally sound, commercial tower <br /> structure in conformance with all good engineering stan- <br /> . dards. Orig inally, the proposed antenna location was in <br /> the middle of his backyard in an exposed. location. Mr. <br /> Kahnke and his wife, wishing to be the best possible <br /> neighbors, now propose to place the tower and antenna <br /> closer to their home, nestled among the house and several <br /> large trees. This location would reduce visibility of the <br /> antenna and, presumably, minimize any asthetic considera- <br /> tions. (Note drawing with proposed antenna location and <br /> amended proposed antenna location.) <br /> As r have previously indicated, Mr. Kahnke's purpose is to <br /> work cooperatively with the Village of Arden Hills in <br /> arriving at a mutually satisfactory result. <br /> Please feel free to contact me, at your convenience, <br /> regarding any questions you may have concerning the mater- <br /> ials r have enclosed in this letter. <br /> Should the Village of Arden Hills be interested in modi- <br /> fying its existing ordinance to conform to the amateur <br /> radio pre-emption order referred to above, please feel <br /> free to contact me. r may be able to obtain additional <br /> resources for you, including sample ordinance provisions <br /> ava ilable through the Office of the General Counsel of <br /> . <br />
