Attachment I <br />'It <br />-A "EN <br />CITY OF ARDEN HILLS <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION NO.2024-007 <br />RESOLUTION APPROVING A VARIANCE <br />AT 1666 OAK AVENUE <br />WHEREAS, City Staff received a complete land use application for a variance to the front <br />yard setback on a corner lot from the City Code for the property located at 1666 Oak Avenue and <br />legally described on Exhibit A attached hereto ("Subject Property"); and <br />WHEREAS, the Applicant is proposing to construct a covered porch addition on an <br />existing nonconforming dwelling structure and is seeking flexibility with the required front yard <br />setback on the Subject Property; and <br />WHEREAS, the Subject Property is zoned R-1, Single Family Residential District, which <br />requires a front yard setback of 40 feet on the Subject Property. The Applicant is proposing a front <br />yard setback of 29.6 feet; and <br />WHEREAS, a variance may be granted when it is in harmony with the general purposes <br />and intent of the zoning ordinance if enforcement of a provision in the ordinance would cause the <br />landowner practical difficulties; and <br />WHEREAS, pursuant to Minnesota State Statute, the City must act on this request by <br />January 11, 2024 (60 days), unless the City provides the petitioner with written reasons for an <br />additional 60-day review period; and <br />WHEREAS, pursuant to Minnesota State Statute, the City provided the petitioner with <br />written reasons for an additional 60-day review period, and the City must act on this request by <br />March 29, 2024; and <br />WHEREAS, the City Council directed Staff to prepare a Land Use Application Public <br />Policy Notification to notify all property owners within 500 feet of Subject Property when a request <br />for the Planning Commission is to occur related to a land use application that does not require a <br />public hearing; and <br />WHEREAS, the City's obligation has been met where the Arden Hills Planning <br />Commission reviewed the application on January 3, 2024. All written comments submitted in <br />advance of the meeting were presented to the Planning Commission; and <br />Page 1 of 3 <br />
