Buyer shall provide all subdivision, lot split, site plan or other <br /> approvals arising or resulting from or necessitated by the transactions described herein. <br /> Buyer hereby approves the lot split resulting from the division of Seller's property Into 'n'~ <br /> the parcels designated herein as Land and Adjacent Land, and approves the site plan for Buyer l <br /> the Adjacent Land submitted by GP, a copy of which Is attached as Exhibit B,'" Buyer Sell " <br /> shall have no rights over any part of the Adjacent Land other than the Easement Area. A.P <br /> 3.2 ROADWAY. <br /> (a) GP shall have the right, at its expense, to construct an entrance and <br /> roadway from Hamllne Avenue to the Adjacent Land In the cross-hatched area shown on <br /> the attached Exhibit B. Such construction shall meet reasonable Village standards to <br /> permit the use of such entrance and roadway by the Village's f!refighting equipment. <br /> (b) At such time as the roadway shown as "future service drive" Is installed, <br /> such Installation shall be accomplished at Buyer's expense and Buyer shall have no right <br /> to assess or otherwise charge GP for the cost of Installing or maintaining said service <br /> drive. <br /> . (c) Buyer acknowledges that It Is critical to the development GP proposes <br /> on the Adjacent Land that the occupant of the Adjacent Land have the right to make <br /> right and left-hand turns from Hamllne Avenue to the Adjacent Land and right and left- <br /> hand turns from the Adjacent Land to Hamllne Avenue. Buyer agrees that it will allow <br /> GP (and all parties claiming under GP, Its successors and assigns) the right to such turns <br /> In perpetuity. <br /> 3.3 NEAR INTERSECTION. Buyer agrees that GP, Its successors and assigns, <br /> sl)all have no obligation to Buyer whatsoever for the repair, maintenance and control of <br /> the triangular-shaped area located at the Northeast comer of the Adjacent Land. <br /> 4. CLOSING AND POSSESSION. <br /> 4.1 DATE AND LOCATION. Closing shall take place at the office of Buyer's <br /> counsel on January 5, 1988, as to Parcel Aj on January 5, 1989, as to Parcel B; and on <br /> January 5, 1990, as to Parcel C. At Buyer's option, the closings for Parcels Band C shall <br /> take place at any time after the Parcel A closing but prior to the closing date indicated <br /> for such parcel. <br /> 4.2 CLOSING DOCUMENTS. Seller shall execute and deliver to Buyer at each <br /> closing a warranty deed to the parcel closed which shall reserve to each parcel of the <br /> Land appropriate rights to the Easement Area.
