MINUTES OF THE ARDEN HILLS REGULAR COUNCIL MEETING <br /> December 14, 1987, 7:00 p.m. - Village Hall <br /> CALL TO ORDER Pursuant to due call and notice thereof, Mayor Woodburn <br /> called the meeting to order at 7:00 p.m. <br /> ROLL CALL The roll being called the following members were present: <br />. Mayor Robert Woodburn, Councilmembers Nancy Hansen, Gary <br /> Peck, Thomas Sather and Jeannie Winiecki. Also present: Attorney James Lynden, <br /> Planners Orlyn Miller and John Bergly, Engineer Barry Peters, Treasurer Frank <br /> Green, Parks Director John Buckley, Public Works Supervisor Robert Raddatz, Clerk <br /> Administrator Patricia Morrison and Deputy Clerk Catherine Iago. <br /> CLOSED MEETING; RE Council discussed labor negotiations at a closed meeting <br /> LABOR NEGOTIATIONS between 7:00 and 7:30 p.m. <br /> PRESENTATION: FALL Council Was advised that Amy Brundell, a member of the <br /> FESTIVAL PROCEEDS Chamber of Commerce and Fall Festival Committee, would be <br /> presenting a check to the Village, in the amount of <br /> $342.00, to be placed in the Park Fund. The check represented the proceeds from <br /> the 1986/87 Fall Festival. <br /> Mayor Woodburn accepted the check and, on behalf of the Village thanked the <br /> Chamber of Commerce and members of the Fall Festival Committee for their <br /> extensive work on the festival and their support of the Village. <br /> APPROVE MINUTES Peck moved, seconded by Hansen, that Council approve the <br /> minutes of the Regular Council Meeting of November 30, <br />. 1987, as submitted. Motion carried unanimously. (5-0) <br /> BUSINESS FROM FLOOR <br /> ADD'L AGENDA ITEM; Councilmember Hansen requested that the Fire Board Report <br /> FIRE BOARD REPORT be added to the Council Agenda, after Item #16. Council <br /> concurred with her request. <br /> RENDERING PLANT; Council was referred to a memorandum from the Clerk <br /> 1988 AGREEMENT Administrator, dated 12-10-87, regarding the Kem Milling <br /> Agreement. <br /> Bob Boesel, member of the citizens' committee, was present and advised the <br /> committee has prepared a report: added that he had an opportunity to review the <br /> MPCA file, dating back to 1969, and noted that there was evidence the plant has <br /> experienced problems since that time. Boesel explained that plant observations <br /> have recently been made; findings reflect that odor emissions from the Arden <br /> Hills plant are distinguishable from the two plants in New Brighton. He also <br /> advised Council that the MPCA has realigned personnel; Jerry Liefert has been <br /> assigned to handle permits for all three plants and has expressed an interest in <br /> finding a solution to eliminate odor emissions. <br />. Robert Freed, citizens. committee member, stated that the community and Council <br /> must place requirements on the plant to bring it into compliance with MPCA rules; <br /> it is his opinion the Village has been lax in enforcement of the MPCA standards. <br /> He recommended that the permit not be extended. <br /> Council asked the Attorney for an opinion as to what options the Village would <br /> have to enforce plant compliance. <br /> Lynden advised that there are conditions listed in the annual agreement and the <br /> Village has the power to alter those conditions; he also noted there is a <br /> Resolution, adopted in 1979, which provides for revoking or suspension of the <br /> agreement. <br /> Cal Meury, 4011 Fairview Avenue North, questioned if there was provision for <br /> imposing a penalty for non-compliance to conditions set in the agreement. <br /> Lynden advised there is a provision in the agreement which states if such <br /> violations are determined by the Council to exist, the company shall be given six <br /> weeks to present a plan and timetable for modifications or additions to the air <br /> pollution control equipment of the Company so as to eliminate such violation: the <br /> Council would review and appprove the plan and timetable with any modifications <br />. deemed necessary by the Council and shall become a condition of the permit <br /> granted to the company. <br />~ <br />
