Easement Vacation Request <br />The Applicant is requesting to partially vacate the existing drainage and utility easement to allow <br />for the expansion of an existing deck in the rear yard. The Certificate of Survey showing the area <br />of the request for partial vacation of the Drainage and Utility Easement is shown in Attachment B. <br />The proposed deck would be 448 square feet in place of a 370 square foot deck which has started <br />to deteriorate. The proposed location of the deck would encroach on the current drainage and utility <br />easement. The proposed vacation is for a triangle at the southwest of the existing buildable pad on <br />the plat. It has been verified that the proposed area to be <br />vacated would not impact ongoing maintenance or functionality of an adjacent storm sewer outlet <br />with the grading plan as submitted by the Applicant. Staff has shared the proposed easement <br />vacation with representatives of the Minnesota Board of Water and Soil Resources and Rice Creek <br />Watershed District and the proposal did not raise concerns. The Applicant confirmed with Rice <br />Creek Watershed District that additional permitting from that entity would not be required. A <br />request for a Vacation of Easement requires a public hearing before the City Council. <br />Page 3 of 4 <br />
