CONSENT ITEM — 8H <br />,-AI�EN�HILLS <br />MEMORANDUM <br />DATE: March 11, 2024 <br />TO: Honorable Mayor and City Councilmembers <br />Dave Perrault, City Administrator <br />FROM: Jessica Jagoe, Community Development Director <br />SUBJECT: Planning Case #23-024 — Mister Car Wash Development Agreement <br />Council Should Consider <br />Motions to approve, table, or deny the following: <br />• Development Agreement for Mister Car Wash (CWP West, LLC) based on the City <br />Council approval of Planning Case 23-024 on February 12, 2024. <br />Background <br />On February 12, 2024, the City Council approved a Conditional Use Permit and Planned Unit <br />Development for Mister Car Wash at 3751 Lexington Avenue North. The project was approved <br />with 25 conditions. The proposal includes the demolition of the existing vacant restaurant building <br />to allow for the site to be redeveloped with a one-story car wash tunnel building, approximately <br />5,400 square foot conveyor -type, stand-alone exterior drive -through car wash. <br />This project requires a Development Agreement between the City and the Developer before the <br />development permits can be issued. The City Attorney has prepared the Agreement and the <br />document has been reviewed and approved by the Applicant and staff (Attachment A). <br />Options and Motion Language <br />Staff has provided the following motion language for this case. <br />1. Approval: Motion to approve the Development Agreement for Mister Car Wash based on the <br />City Council approval of Planning Case 23-024 on February 12, 2024. <br />2. Denial: Motion to deny the Development Agreement for Mister Car Wash based on the City <br />Council approval of Planning Case 23-024 on February 12, 2024: the City Council should <br />identify findings to deny should specifically reference the reasons for denial and why those <br />reasons cannot be mitigated. <br />Page 1 of 2 <br />
