. 9. The City shall pay 10% of its share of the construction cost, as determined by the contract as awarded, to the County as a preliminary engineering fee. The preliminary engineering fee shall be due upon award of the construction contract. 10. The City shall pay 12% of its share of the construction costs, as determined by the final contract amounts, to the County as a construction engineering fee. The construction engineering fee shall be due upon notification to the City of the final amounts due to the contractor. II. The City shall not assess or otherwise recover any portion of its costs for this project through levy on County-owned property. 12. The County shall prepare the partial payment estimates, approved by the project construction engineer, and notify the City of its share of the costs for the City's items of work. The City shall pay its share of the cost within twenty-one calendar days, and the contractor shall then be paid by the County. 13 . The Ci ty shall pay to the County all additional remaining costs for its share of the work upon notification by the County of the final amounts due to the contractor. 14. All payments by the City shall be to the Treasurer of Ramsey . County, Minnesota. 15. All monies paid by the City and not expended on the project will be returned within a reasonable time not to exceed two (2 ) years from deposit. 16. Preliminary plans reviewed at the public hearing and final plans and specifications are hereby in all things approved.
