<br />. . <br /> RECOMMENDATION BY ARSENAL STUDY GROUP <br /> TO PLANNING COMMISSION AND SUBSEQUENT <br /> RECOMMENDATION TO ARDEN HILLS CITY COUNCIL <br />. After analysis of past and present history of TCAAP, including <br /> pollution of water and land, altering of the topography of the <br /> land and subsequent removal of sand and gravel, lowering the <br /> value of that land, violation of E.P.A. laws and regulations <br /> plus disregard of suggestions by Arden Hills, the violation of <br /> Arden Hills' ordinances and suggestions, the refusal to <br /> negotiate any items of interest to the city by stating <br /> repeatedly that we have "no jurisdiction", the lack of <br /> dialogue to conside~ the impact on Arden Hills, the transfer <br /> of property to the Army Reserve and subsequent altering of the <br /> land and wetland without an Environmental Impact Statement and <br /> consideration without approval of local government as to its <br /> location of the Army Reserve, including permits from Rice <br /> Creek Watershed and other agencies, it is our recommendation <br /> that the following suggestions be followed: <br /> 1. That the Arden Hills City Council seek a court injunction <br /> demanding that TCAAP cease and desist any and all <br /> operations on its present site, including that portion or <br /> any other portion of property transferred to other <br /> agencies until TCAAP has complied with all local <br /> ordinances, laws, and regulations, as well as all other <br /> local, state, federal and EPA laws and regulations on the <br /> land now occupied by TCAAP or any other agencies within <br />. its boundaries. <br /> 2. That the Arden Hills city Council immediately commence <br /> action to file for and collect fees from TCAAP for past, <br /> present, and future for its use of this property in lieu <br /> of taxes, as is the practice of the DNR for its managed <br /> property. <br /> 3 . That the Arden Hills city Council immediately commence <br /> action to seek the removal or relocation of the TCAAP as <br /> it Obviously has no place in an urban or suburban <br /> environment. <br /> 4. That the Arden Hills city Council take necessary action to <br /> insure that the city of Arden Hills has the right of first <br /> refusal to the land now occupied by TCAAP. <br /> 5. That the Arden Hills city Council conduct further legal <br /> action for the recovery of any and all funds due the City <br /> or taxpayers due to any acts by TCAAP. <br />. <br />
