Meyer, Attorney for Estate minneapolis, mn 55416 <br /> of Bernice Medlin 6125447576 <br /> Date: August 1, 1990 <br /> REQUEST: <br /> Lot 6 is located at the northeast corner of the intersection of Hamline <br /> Avenue and Amble Road. The lot is 13B feet wide by 297 feet deep and <br /> contains 40,986 square feet. The proposal is to divide the parcel into <br /> three lots. The westerly lot (A) contains a small residence, is 14,766 <br /> square feet in area, and meets area, width and depth requirements. Lot <br /> B, the center lot, and Lot C, the easterly lot, each contain 13,110 <br /> square feet (14,000 square feet required) and meet the lot width and <br /> depth requirements. The requested variance is for reducing the required <br /> lot area by 890 square feet for Lots Band C. <br /> CONSIDERATIONS: <br /> . 1. Lot A, being a corner lot, is required by the subdivision ordinance <br /> to be 10 feet wider than normal. It is proposed to be 12 feet <br /> wider to allow for a 10-foot side yard from the existing residence. <br /> The existing garage and "breezeway" would be removed. <br /> 2. Lots Band C would have to be nine feet deeper (147.4 feet instead <br /> of 138.0 feet) to meet the minimum area requirement of 14,000 <br /> square feet. <br /> 3. The variance provisions for subdivisions are somewhat less <br /> restrictive than those for zoning variances, i.e.: <br /> (1) There are special circumstances or conditions <br /> affecting said property such that strict <br /> application would deprive the applicant of <br /> reasonable use of his land. <br /> (2) The variance is necessary for the preservation and <br /> enjoyment of a substantial property right of the <br /> applicant. <br /> (3) The granting of the variance will not be injurious <br /> to the public welfare or injurious to other nearby <br /> property owners. <br /> .
