Minnesota 55440.4700 612/853.3791 July 1.1., 1.990 Mr. Dennis Foster 1.41.5 Arden Hills Drive Arden Hills, MN Re: Description of Easement for Roadway Adjacent to Tract being Purchased from Control Data Corporation Dear Mr. Foster: In connection with your purchase of the Tract in Arden Hills between Lexington and Fernwood Avenues, Control Data's management has approved granting you a roadway easement along the northern boundary of that Tract which is to include the following description and conditions: 1.. The easement width will be from the Northern line of the Tract you are purchasing to the curb line on the Northern side of the current paved roadway. . 2. The easement will be permanent for that portion of the current roadway which is on Control Data owned land - from Lexington Avenue westerly for approximately 260 feet. 3. The remaining portion of the easement will be for a time so long as Control Data is Lessee of the property on Which the roadway is located and will become permanent if Control Data obtains fee - ownership to that land. 4. You will be entitled to make a curb cut in the Southern curb of the roadway at your own cost and expense. 5. The roadway easement will be for customer traffic and will not be used by construction vehicles. 6. You will be responsible for your share of the maintenance and repair of the roadway. 7.
