The tack that Reiling is taking is that, based on Don <br /> Schmidt's testimony which I think will be what he will be <br /> principally relying on, in order to develop his property utilizing <br /> Arden View Drive he has to move a substantial amount of dirt which <br /> involves expense that he would not incur if he were to subdivide <br /> his property without using Arden View Drive. He calculates the <br /> cost of removing the dirt to utilize Arden View Drive at 23,302 <br /> cubic yards for a value of $116,510. I have asked John Bergly and <br /> Don Christoffersen to consider his calculations as to the necessity <br /> of moving that amount of dirt in order to develop the lots along <br /> Arden View Drive. r suspect that it is not necessary to move that <br /> quantity of dirt and that there is only one let where thare is a <br /> significant access problem and that that lot, which is on the high <br /> point of the hill, could be approached from the east without a <br /> significant change in the elevation of the ground. On the flip <br /> side, Don Schmidt's plan utilizing Arden View Drive means that <br /> there would be two more lots and 400 less feet of road necessary <br /> which would probably eliminate the cost of the removal of the dirt. <br /> There are also questions as to whether, if the dirt needs to be <br /> removed, whether it couldn't be utilized on the property to fill in <br /> some of the low area and I have asked Don and John Bergly for their <br /> opinion on that as well. <br /> This case is set for trial on January 10. Reiling's <br /> . claim is likely to be something in the area of $200,000 but I won't <br /> know that until I have deposed his appraiser. Our appraiser will <br /> say that there has been a loss of value to Reiling's property of <br />
