Ass't,. <br /> ATTN: Mr. Gary Peterson <br /> SUBJECT: Regulatory Issues Concerning Lots in Edgewater Estates, Arden Hills <br /> Dear Mr. Halva: <br /> On December 31, 1991, you requested I send you a letter stating the issues that may be involved in <br /> getting final approval for a final grading plan in Edgewater Estates. The comments I have are as <br /> follows: <br /> 1. A permit will be required by the RCWD since this is a grading change occurring to a <br /> previously submitted plan. <br />. 2. The part of the easement being vacated by the U.S. Fish and Wildlife Service is of some <br /> concern to us. We need documentation from the U.S. Fish and Wildlife Service showing they <br /> have agreed to vacating this part of the easement. The documentation is for our files, Any <br /> other easements should be shown on the plat provided with the permit application. <br /> 3. With the Minnesota Wetland Act of 1991 being implemented as of January 1, 1992 (Interim <br /> Program), the District will be closely reviewing wetland impacts and seeking to avoid <br /> wetland disturbance, Keep in mind that the main thrust of this Act is no net loss of wetlands. <br /> A qualified professional may be required to delineate wetlands in the affected area, <br /> 4. The original permit application in 1985 shows the proposed grading considerably closer to the <br /> cul-de-sac on Wedgewood Circle. TIle proposed grading could have some impact on whether <br /> the final grading plan is approved or not. <br /> 5. No floodplain fill will be allowed below the 100-year floodplain without compensatory storage <br /> provided. The 100.year floodplain is an area that is inundated by a storm event with a <br /> frequency of occurrence of once in 100 years. The lowest proposed floor needs to be at least 2 feet <br /> above the lOG-year floodplain level. <br /> 6. An erosion control and sedimentation plan will be needed on the final grading plan with a <br /> contact person and telephone number included.
