Councilmember Malone questioned if delay of the project would have any adverse affect on the residents that have experienced problems with drainage. Graham explained Mr. Noye::J. has had drainage problems for a number of years and was initially advised that although the project is presented to Council, it nay not be a=omplished in 1991. Wally Bauer, builder of the new home on Arden Place, presented info:mation to Council relating to the soil conditions of the lot where the new home was constructed. Bauer stated the previous owner of the property inferred that the lot was "unJ::uilclable", due to poor soil conditions. He advised the reports show the final testing results, after soil co=ections were nade on this site. Councilmember Malone thanke::J. Bauer for the info:mation. SI'ATUS REF0RI'; Council was referred to the November 8 memorandum and KEITHSON POND attachments from the Clerk Administrator, relating to Keithson Pond. r. " Attorney Filla advised he spoke to Mr. Reiling's legal counsel on Friday, November 8, and as of this date the Waiver of Trespass has not been signed by Reiling. He stated the Hearing set on November 22, for the purpose of appointing Commissioners to detennine damages to the property, will proceed as schedule::J.. Filla explained if the Waiver of Trespass is received within a short perio:l of time, the city nay J::e able to construct a trench on the Reiling property to charmel water from the pond. The Attorney reconnnende::J. Council consider directing staff to pursue remedies under the development agreement.Ior this project; such as grading of the pond by the developer. He suggeste::J. an estiJ:nate of the costs for grading the pond should J::e provided by the city Engineer. Filla further reconnnende::J. the developer J::e advised that the city intends to pursue remedies to insure the developer satisfies obligations stipulate::J. in the development agreement for this project, and offer the developer the opportunity to charmel water from the site during the grading process, if the Waiver of Trespass is received from Mr. Reiling. There was discussion relative to the extent of city involvement in the trenching and grading of the pond. ~. Filla commented that it nay J::e important for the city to review the costs associated with such a project and discuss financial responsibility for the project. He indicated the city nay not wish to undertake the entire project. "-
