Bauer stated the previous owner of the property inferred that the <br /> lot was "unJ::uilclable", due to poor soil conditions. He advised the reports show <br /> the final testing results, after soil co=ections were nade on this site. <br /> Councilmember Malone thanke::J. Bauer for the info:mation. <br /> SI'ATUS REF0RI'; Council was referred to the November 8 memorandum and <br /> KEITHSON POND attachments from the Clerk Administrator, relating to <br /> Keithson Pond. <br />r. <br />" <br /> Attorney Filla advised he spoke to Mr. Reiling's legal counsel on Friday, <br /> November 8, and as of this date the Waiver of Trespass has not been signed by <br /> Reiling. He stated the Hearing set on November 22, for the purpose of appointing <br /> Commissioners to detennine damages to the property, will proceed as schedule::J.. <br /> Filla explained if the Waiver of Trespass is received within a short perio:l of <br /> time, the city nay J::e able to construct a trench on the Reiling property to <br /> charmel water from the pond. <br /> The Attorney reconnnende::J. Council consider directing staff to pursue remedies <br /> under the development agreement.Ior this project; such as grading of the pond by <br /> the developer. He suggeste::J. an estiJ:nate of the costs for grading the pond should <br /> J::e provided by the city Engineer. <br /> Filla further reconnnende::J. the developer J::e advised that the city intends to <br /> pursue remedies to insure the developer satisfies obligations stipulate::J. in the <br /> development agreement for this project, and offer the developer the opportunity <br /> to charmel water from the site during the grading process, if the Waiver of <br /> Trespass is received from Mr. Reiling. <br /> There was discussion relative to the extent of city involvement in the trenching <br /> and grading of the pond. <br />~. Filla commented that it nay J::e important for the city to review the costs <br /> associated with such a project and discuss financial responsibility for the <br /> project.
